CITY OF MUSKEGON MUSKEGON HOUSING BOARD OF APPEALS MEETING MINUTES 04/05/07 5:30PM ATTENDANCE: Randy Mackie, Jon Rolewicz, Chris Carter, Nick Kroes, Kirk Kolberg ABSENT: EXCUSED: Greg Borgman, Ed Simmons STAFF: Mark Kincaid, Jim Hoppus, Laura Hichue, Don LaBrenz, Ken Murar, Henry Faltinowski,Scott Vanderwier GUESTS: Romon A Medrano(740 Wesley), William J. Gilliken(2317/2319 Denmark) Meeting minutes: A motion was made by Randy Mackie and seconded by Chris Carter to approve the March 2007 minutes. O:\Inspections\Grabinski_Lorraine\Word\HBA MEETINGS\Agenda & Min. 2003 & 2004\MINUTES 04-05-07.doc 1 OF 4 PROPERTY MAINTENANCE CODE APPEAL CASES: 2317-2319 Denmark – Gilliken Rental & Investment – 1860 Nielwood, Muskegon, MI 49445 Mr. Gilliken was present to represent case. Mr. Gilliken stated he had problems contacting inspector. Mark Kincaid said the problem was the invoices were from last year March, September, and October and the Property Maintenance Code provides for a 20-day appeal period. Chris Carter asked why three invoices were issued. Mark Kincaid stated invoices were for inspections and re-inspection scheduled that owner failed to be present for inspection. He said inspector tried to contact owner but was unable to make contact. Mr. Gilliken said he was only aware of the one inspection and not aware of the other two until he received all three voices at one time. Jon Rolewicz reviewed invoices. Chris Carter asked if owner is notified in writing that no show inspections will be billed. Mark Kincaid stated yes; and said a letter was sent to owner on 11/14/06 referencing the violation. Chris Carter asked what the window period is before an inspection can be cancelled. Mark Kincaid stated three days. Staff Recommendation: Deny appeal Motion made by Randy Mackie and supported by Chris Carter to accept staff recommendation. DANGEREROUS BUILDING NEW CASES: EN-070025 – 740 Wesley Ave. – Romana Medrano, 1075 Holt St., Muskegon, MI 49442 Romon Medrano, son of owner was present to represent case. He said he had a cleanup crew to remove debris, he said there are three walls needing to be drywalled and flooring needs repair and would like time to complete repairs. Mr. Medrano said hot water heater was new and some plumbing was done. Jim Hoppus said registered contactor would have to do plumbing. Staff Recommendation: Table case until July 2007 to allow owner time to get permits and provide timeline to complete repairs. Motion made by Randy Mackie and seconded by Jon Rolewicz to accept staff recommendation. OLD BUSINESS: Scott Vanderwier asked about the status of 1121 Third, he reported that a window was kicked out, informed Inspections and a boardup letter was sent to owner. Mark Kincaid stated the problem with this building it’s a complicated tear down because it’s a shared wall with the other two structures and the demolition budget is very limited and cost would absorb much of funds left. Scott Vanderwier asked if there was any pressure that could be put on owner to make necessary repairs. Mark Kincaid stated that case has already been put thru the proper channels and has been condemned by City of Commission. Chris Carter asked about email sent to Inspections regarding 431 Orchard. Mark Kincaid stated case was on agenda for City Commission work session this coming week. The board discussed with staff possible solutions for repair enforcement issues. John Rolewicz asked about house on Yuba or Muskegon and Mark Kincaid said he would send someone to take a look at it. Jon Rolewicz asked about re-appointment of board members and Don LaBrenz stated appointments were approved. The City of Muskegon will provide necessary reasonable auxiliary aids and services, such as signers for the hearing impaired and audiotapes of printed materials being considered at the meeting, upon twenty-four hours notice to the City of Muskegon.
