CITY OF MUSKEGON MUSKEGON HOUSING BOARD OF APPEALS MEETING MINUTES 03/03/05 5:30PM ATTENDANCE: Randy Mackie, Greg Borgman, Nick Kroes, Jon Rolewicz, Ed Simmons, John Warner ABSENT: EXCUSED: Clara Shepherd STAFF: Henry Faltinowski, Laura Hichue, Don LaBrenz, Anthony Kleibecker, Kevin Stier, Major Metcalf GUESTS: Maria Morales/Francisco Galindo (775 Washington) Students from Muskegon High School Meeting minutes: Correction noted on spelling of name from Mark Pascone to Mark Tascone (565 Adams) a motion was made by John Warner and seconded by Jon Rolewicz to approve the February minutes. The motion passed unanimously. DANGEROUS BUILDING REVIEW CASES: EN– 030115 – 775 Washington –Annette Homoley, 11385 E. Sherman, Ravenna, MI 49451. Maria Morales/Francisco Galindo was present to represent this case. Anthony Kleibecker reviewed case and passed out photos. Francisco Galindo stated they had a land contract with Annette Homoley which he didn’t have a copy present. Mr. Galindo showed pictures of new windows and stated house had been gutted out and he wanted extension to complete repairs. Anthony Kleibecker asked if house was purchased 08/10/04 and was he aware permits expired 08/17/04 and if any work had been done since the permit expired? Mr. Galindo stated nothing had been done but the windows and doors. Don LaBrenz stated that once Ms. Homoley sold the house that permits pulled by her were of no value to Mr. Galindo. Don stated he drove by the house and noticed bedroom windows were wrong and he said if HBA grants an extension it’s really important that Mr. Galindo get in contact with the Inspections O:\Inspections\Grabinski_Lorraine\Word\HBA MEETINGS\Agenda & Min. 2003 & 2004\MINUTES 03-03-05.doc 1 OF 4 Department to schedule a walk thru so he’s aware of everything necessary that needs to be done to complete this project. Henry Faltinowski stated if he plans to take this on he needs to get a full list of repairs and information on proper way to do things as he mentioned the bedroom window was the wrong size and its required by code that a egress window be installed and he mentioned framing was done wrong. Anthony Kleibecker stated that the Inspection Department needs to see copy of Land Contract for file and progress will be reported to board at the next HBA meeting. Staff Recommendation: Table for 30 days to allow Inspections to walk through and work out schedule for repairs. A motion was made by Randy Mackie and seconded by Jon Rolewicz to accept staff recommendation. DANGEROUS BUILDING NEW CASES: EN-040054 – 1123 Chestnut – Long Lam, 6801 Gettysburg, Hudsonville, MI 49426 No one was present to represent this case. Anthony Kleibecker reviewed case stating dangerous building inspection conducted 05/06/04. Permit issued 07/07/04 but expired 11/07/04. There has been no owner contact since that time. Staff Recommendation: Declare this building substandard, a public nuisance, and dangerous building. OLD BUSINESS: Anthony Kleibecker informed the board that the two housing inspectors, Pete Vanderlaan and Roxie Wever had been recalled to their positions and were up and running full time. Nick Kroes reported 1530 Hoyt, the porch roof falling in. Anthony Kleibecker stated that 1530 Hoyt was awarded to Franklin Contractor to be demolished. NEW BUSINESS: Greg Borgman expressed appreciation for commissioner Kevin Davis attendance at the last HBA meeting and noted Nick Kroes comment that the HBA have not be given any other options or authority but to condemn homes if not rehabbed by property owners in response to Mr. Davis question why do the HBA demo everything. Greg Borgman would like some members to be on an Ad HOC committee to explore ways to come up with a method to keep buildings from decaying such as levying fines or penalties and come up with a document to present to commission for their adoption. Anthony Kleibecker said he would ask John Schrier to attend April’s meeting to discuss these issues. Nick Kroes asked about 143 W. Southern regarding “no occupancy” sticker scraped off. Anthony Kleibecker said the homeowner had been cited. Greg Borgman inquired about the Gooden property at 523 W. Webster. Anthony Kleibecker said he would check with John Schrier regarding dates for consent judgement. Greg Borgman asked about Scott Sieradzki’s property. Anthony Kleibecker said meeting is scheduled for 03/28/05 with both Sieradzki’s and one is a pretrial for Scott Sieradzki regarding 557 W. Clay.
