CITY OF MUSKEGON MUSKEGON HOUSING BOARD OF APPEALS MEETING MINUTES 04/07/11 5:30PM ATTENDANCE: Randy Mackie, William Krick, Greg Borgman, Ed Simmons ABSENT: Chris Carter, Jon Rolewicz EXCUSED: Kirk Kolberg STAFF: Carmen Smith, Jim Hoppus, Anthony Kleibecker, Don LaBrenz II GUESTS: Tenants of 500 W. Western Meeting minutes: A motion was made by Randy Mackie and seconded by William Krick to approve the March 2011 minutes. DANGEROUS BUILDING REVIEW CASES EN-100199 – 1170 ALLEN(GARAGE) – KENNETH JORDAN/SANDRA JENKINS – 1277 ISABELLA, MUSKEGON, MI 49442 Case was removed from agenda. Owners obtained permit to repair structure 04/04/11. DANGEROUS BUILDING NEW CASES EN-110018 – 657 Allen(Garage) – Janet Young – 657 Allen Ave., Muskegon, MI 49442 B:\hba\MINUTES 04-07-11.doc 1 OF 4 No one was present to represent property. Anthony Kleibecker reviewed case stating there has been neither compliance nor contact with owner. He said he drove by structure Tuesday and observed that it’s leaning in bad condition the case was brought to the attention of Inspections by neighborhood police officer. Staff Recommendation: Declare the structure substandard, dangerous and a public nuisance. Randy Mackie made motion to accept staff recommendation and was seconded by Ed Simmons. WESTERN – COMMERCIAL BLDG. – DAVID E. FARHAT, 3461 WHISPERING WOODS DR., MUSKEGON, MI 49444 The owner of property was not present but tenants of the commercial building were in attendance to observe meeting. Anthony Kleibecker reviewed case stating it is a commercial building and on southeast side of exterior the brick is bubbling out and posing a threat to pedestrian traffic. The extent of damage has not been ascertained. He stated Don LaBrenz II, had spoken with the owner a few times and did postpone from putting case on the agenda last month. He stated the event season is upon us and there is a concern for safety. Jeff Vanderstelt, tenant stated his concerns and wanting to know the process so as not to have the doors locked on tenants. Anthony Kleibecker stated this meeting is first step to bring pressure on the building owner to address repairs. The bank has also expressed interest in building. Greg Borgman stated he had advised Mr. Farhat that it would be in best interest to attend meeting. Don Labrenz also stated he had advised owner that written correspondence could be submitted if he couldn’t attend but no written statement had been received. William Krick asked tenant if any damage had been seen inside building. Mr. Vanderstelt stated he had not seen anything inside his section of the building but it was obvious damage outside. Staff Recommendation: Declare the structure substandard, dangerous and a public nuisance. OLD BUSINESS: NEW BUSINESS: Jim Hoppus said it was brought to his attention that bricks were falling from General Plumbing structure on Ottawa St. Anthony Kleibecker stated he would contact Fire Marshall to look into matter.
