CITY OF MUSKEGON MUSKEGON HOUSING BOARD OF APPEALS MEETING MINUTES 09/01/11 5:45 PM ATTENDANCE: Randy Mackie, William Krick, Greg Borgman, Chris Carter ABSENT: Jon Rolewicz, Kirk Kolberg EXCUSED: Ed Simmons STAFF: Carmen Smith, Jim Hoppus, Don LaBrenz II, Ken Murar, Hope Mitchell GUESTS: David Wotli (1642 Dyson), Stanley Sieradzki(557 W. Clay) Meeting minutes: A motion was made by Randy Mackie and seconded by William Krick to approve the August 2011 minutes. A roll call vote was taken: AYES: NAYES: EXCUSED: ABSENT: ABSTENTION: Greg Borgman Randy Mackie Jon Rolewicz William Krick Chris Carter Ed Simmons Kirk Kolberg Motion carried. PROPERTY MAINTENANCE CODE APPEAL 1642 DYSON – DAVID/SANDRA WOTLI-1724 BEIDLER ST, MUSKEGON, MI 49441 Mr. Wotli was present to represent case. Mr. Wotli stated Ken Murar on 7/29/11 showed up for inspection but only took pictures of the electrical box and left. He said he received notice showing violations uncorrected. He said the man that did all the work is present and can testify that work was completed prior to inspection date. Mr. Wotli said he was wondering if inspector had vendetta against him because of previous appeal. Ken Murar stated he did show up to do inspection and tenant informed him she was not informed of inspection and not ready. Mr. Murar stated he asked 1 OF 4 tenant if he could take picture of electrical panel because of questioned item on appeal. The tenant agreed to allow Mr. Murar to take picture which he did and left. Mr. Murar stated usually when inspector is denied access there is a $50.00 charge but since tenant had allowed him to take picture he waived the fee and since no inspection was done the report states items were still uncorrected. Dave Wotli said he could not verify information stated by Mr. Murar because tenant could not be present but told him a different story. Ken Murar stated there is no charge and it has been rescheduled. Chris Carter said it sounds like there has been a misunderstanding so no reason for animosity. Motion made by Randy Mackie to table case until October meeting and was seconded by Chris Carter. A roll call vote was taken: AYES: NAYES: EXCUSED: ABSENT: ABSTENTION: Greg Borgman Randy Mackie Jon Rolewicz William Krick Chris Carter Ed Simmons Kirk Kolberg Motion carried. 1174 Wood – Karen Aubry – 15928 Hunsaker Ave. #8, Paramount, CA 90723 No one was present to represent property. Hope Mitchell, Code Coordinator stated property was originally inspected by Craig Porter 09- 29-10 when the fence was wrote up. Upon further investigation Hope Mitchell said she realized that the appeal should have been submitted 20 days after inspection which in this case has exceeded time limit and the owner has had more than enough time to repair the fence. She stated owner was asking for a date next year to repair. Chris Carter asked if property was one that the City had rebuilt. Randy Mackie made motion to deny appeal and was seconded by William Krick. DANGEROUS BUILDING NEW CASES EN-110049 – 557 W. CLAY – STANLEY SIERADZKI – 1074 KAMPENGA, MUSKEGON, MI Stanley Sieradzki was present to represent property. Mr. Sieradzki stated he has had a lot of experience with inspectors and wanted to ask that case to be tabled for 30 – 90 days. He said he was in process of getting demolition bids and already has 2 and if it came to demolishing he would prefer to do himself. Greg Borgman asked about homeless person if someone was living there presently which Mr. Sieradzki said no. There was discussion about timeline of when case would go before commissioned if declared by housing board of appeals. Mr. Sieradzki said he was entertaining the idea of repairing or at least preserving back half. Greg Borgman suggested Mr. Sieradzki keep in touch with Inspections and work out a plan. William Krick asked if house was secured so that no one can enter which Mr. Sieradzki answered yes. Chris Carter made a motion to declare the structure substandard, dangerous and a public nuisance with a delay sending to Commission until December 2011and was seconded by Randy Mackie. OLD BUSINESS: NEW BUSINESS: 3 OF 4 Greg Borgman asked about staffing of departments upon the departure of Public Safety Director, Anthony Kleibecker. Don Labrenz updated board on interim staffing of departments. Chris Carter discussed search for right candidate. ADJOURNMENT: 6:10 PM CITY OF MUSKEGON AMERICAN DISABILITY ACT POLICY FOR ACCESS TO OPEN MEETINGS OF THE CITY COMMISSION AND ANY OF ITS COMMITTEES OR SUBCOMMITTEES.
