CITY OF MUSKEGON MUSKEGON HOUSING BOARD OF APPEALS MEETING MINUTES 02/02/2012 5:30 PM ATTENDANCE: Randy Mackie, William Krick, Greg Borgman, Ed Simmons, Kirk Kolberg ABSENT: EXCUSED: STAFF: Carmen Smith, Henry Faltinowski, Jim Hoppus, Don LaBrenz, Chief Jeffrey Lewis GUESTS: David Medendorp Meeting minutes: A motion was made by Randy Mackie and seconded by Ed Simmons to approve the December 2011 minutes. Election of Officers Nomination made by Randy Mackie to re-appoint Greg Borgman as chair-person and a nomination of Randy Mackie as vice-chair by Ed Simmons. Motion made by Kirk Kolberg and seconded by Ed Simmons to approve nominations. DANGEROUS BUILDING NEW CASES EN-110191 – 1357 7th – Jay Dee Properties LLC, 1420 44th St., Brooklyn, NY 11219 David Medendorp was present to represent property. Mr. Medendorp stated they realize the house in question needs work and a new roof. Mr. Medendorp stated owner was under water in his properties and finances. Mr. Medendorp’s company took over managing the properties and tried allocating the funds towards repairs such as the furnace, carpeting. Money was spent on less expensive violations on the homes that were occupied. He stated Mr. Deutsch was selling all his properties next month. Mr. Medendorp stated it was being disclosed that repairs were needed. Mr. Medendorp asked if board could table case for a month so they would know where they are with the properties. Henry Faltinowski stated someone representing auction called him and he wanted to know what would happen if someone bought home. Henry Faltinowski stated that potential buyers should be made aware that home is on Dangerous Building List. He said owner would need to meet with Inspections and schedule interior inspection because of damage to roof system. Mr. Medendorp stated he was in home 3 months ago and had not seen any visible sign of water. Mr. Medendorp asked if new owner could come in and get permit right away. Don LaBrenz stated first owner would need to schedule interior inspection so everyone knows what repairs need to be completed. Mr. Medendorp asked about scenario if owner backs out of sale and defaults back to previous owner. Don LaBrenz said if home is demolished cost would be assessed back to whom ever the homeowner is. Don LaBrenz stated if HBA moves to demolish, the owner still has time to pull permits and make repairs. Bill Krick stated since home has been boarded since October and has hole in roof that is was imperative that potential buyer be made of aware of status. Mr. Medendorp stated he would make sure there would be full disclosure given. Bill Krick stated building was very sore looking. Greg Borgman explained motion. Jim Hoppus asked about houses being bought from auctions site unseen. Mr. Medendorp said he had seen sale of property that way but felt structures in Muskegon were worth investing in but his recommendation to buyers would be to contact realtors to find out what they are getting into. He mentioned fair practice of City Muskegon giving out information regarding properties. Mr. Medendorp stated City of Muskegon was great to work with, he knows what to expect and they are very consistent. Motion was made by Ed Simmons to declare the structure substandard, dangerous and a public nuisance and was seconded by Randy Mackie. EN-110205 – 1469 6th – Antonio Zamarron, 2902 Holland, Mission, TX 78574 No one was present to represent property. Motion made by Randy Mackie to declare the structure substandard, dangerous and a public nuisance and was seconded by Kirk Kolberg. OLD BUSINESS: NEW BUSINESS: Chief Lewis stated he was observing the process and noticed numerous properties on Dangerous Building list and was refreshed to see that the board moved swiftly in removing those structures. Greg Borgman stated board has a passion for resolution. Mr. Borgman stated he has been concerned about the number of roofs not being repaired. He spoke about funding for roofs. Henry Faltinowski spoke about work of CNS in helping to repair roofs. Mr. Krick said neighborhood meeting was positive and community is in sync with what Mayor has started. Their was a discussion amongst board regarding Dangerous building list compared to year ago and funding for demolition. Greg Borgman stated a community officer would sit in on HBA meetings in previous years. Henry Faltinowski stated Police Department is still contacting Inspections regarding potential dangerous structures. Ed Simmons thanked Bryon Mazade for attending meeting and providing needed information.
