CITY OF MUSKEGON MUSKEGON HOUSING BOARD OF APPEALS MEETING MINUTES 05/03/2012 5:30 PM ATTENDANCE: Randy Mackie, Greg Borgman, Ed Simmons, Willie German ABSENT: Kirk Kolberg EXCUSED: William Krick STAFF: Laura Hichue, Henry Faltinowski, Jim Hoppus, Don LaBrenz, Chief Jeffrey Lewis GUESTS: Mike Wyman & Gerry Rich(1692 Elwood) Meeting minutes: A motion was made by Randy Mackie and seconded by Ed Simmons to approve the April 2012 minutes. A roll call vote was taken: AYES: NAYES: EXCUSED: ABSENT: ABSTENTION: Greg Borgman Randy Mackie William Krick Ed Simmons Kirk Kolberg Willie German Motion carried. DANGEROUS BUILDING NEW CASES EN-120013 – 1660 DYSON – ESTATE OF MARSHALL REDDER, C/O 161 OTTAWA, NW, STE 212; GRAND RAPIDS, MI 49503 No one was present to represent property. Chief Jeffrey Lewis stated a letter had been received by Attorney David Schoolenberg regarding property at 1660 Dyson which was heavily damaged by arson. They are proposing a plan to turn over property to the City of Muskegon and sign over restitution order. Staff Recommendation: Table case until the June 2012 HBA meeting to allow City Attorney to review case. Motion was made by Randy Mackie to accept staff recommendation to table case until June 2012 and was seconded by Ed Simmons. A roll call vote was taken: AYES: NAYES: EXCUSED: ABSENT: ABSTENTION: Greg Borgman Randy Mackie William Krick Ed Simmons Kirk Kolberg Willie German Motion carried. EN-120025 – 1692 Elwood – 37 E. Main LLC, P.O. Box 652, Lake Odessa, MI 48849 Mike Wyman and Gerry Rich were present to represent property. He stated their intention was to rehab the property in question and four other properties purchased thru the tax sale. He stated they thought property wasn’t dangerous enough to be demolished and was purchased with intent to rehabilitate. They have applied for the lead grant and rehabilitation program thru Community Neighborhood Services but stipulations requiring ownership of at least one year forces them to wait for those processes. He stated an interior inspection took place and he still has to meet with Don LaBrenz regarding timeline. He stated they want to be involved with rental program and realized property has to meet certain criteria which they plan to bring up to those standards. He wanted some clarification as to the DB violation list requirement. Greg Borgman asked if property was purchased sight unseen which Mr. Rich answered he did ride by homes and planned not to let property deteriorate. Mr. Wyman said their decision to purchase homes in Muskegon was based on utilizing programs to rehab not realizing all the stipulations. He stated if improvements were made with their own dollars then they can’t benefit from the programs offered. Mr. Rich stated they would like to find a compromise regarding items on DB list dealing with exterior violations first. Greg Borgman stated in past experience these types of cases generally never get completed and meeting should have been held with inspections to work out a timeline. Staff Recommendation: Table case until June 2012 HBA meeting. Motion made by Randy Mackie to accept staff recommendation to table case until June 2012 HBA with owner to meet with Inspections Department and establish timeline for repairs motion seconded by Ed Simmons. Davis Trust, 2176 E. Virginia Dr., Muskegon, MI 49444-4420 No one was present to represent case. Motion made by Randy Mackie to declare the structure substandard, dangerous and a public nuisance and was seconded by Ed Simmons. A roll call vote was taken: AYES: NAYES: EXCUSED: ABSENT: ABSTENTION: Greg Borgman Randy Mackie William Krick Ed Simmons Kirk Kolberg Willie German Motion carried. EN-110214 – 1219 RANSOM(GARAGE) – RICHARD DURGA JR., 1219 RANSOM, MUSKEGON, MI 49442 No one was present to represent property. Henry Faltinowski stated there had been limited contact and now the home is also getting to a condition that it might have to be wrote up as dangerous building. Motion made by Randy Mackie to declare the structure substandard, dangerous and a public nuisance and was seconded by Willie German. OLD BUSINESS: NEW BUSINESS: ADJOURNMENT: 5:50 PM CITY OF MUSKEGON AMERICAN DISABILITY ACT POLICY FOR ACCESS TO OPEN MEETINGS OF THE CITY COMMISSION AND ANY OF ITS COMMITTEES OR SUBCOMMITTEES. The City of Muskegon will provide necessary reasonable auxiliary aids and services, such as signers for the hearing impaired and audiotapes of printed materials being considered at the meeting, upon twenty-four hours notice to the City of Muskegon.
