MINUTES
The Regular Commission Meeting of the City of Muskegon was held at City
Hall, 933 Terrace Street, Muskegon, Michigan at 5:30 p.m., Tuesday, March l l,
2008.
Mayor Warmington opened the meeting with a prayer from Vice Mayor
Stephen Gawron after which the Commission and public recited the Pledge of
Allegiance to the Flag.
ROLL CALL FOR THE REGULAR COMMISSION MEETING:
Present: Mayor Stephen Warmington, Vice Mayor Stephen Gawron,
Commissioners Chris Carter, Lawrence Spataro, Sue Wierengo, and Steve
Wisneski, City Manager Bryon Mazade, City Attorney John Schrier, and City Clerk

2008-25 CONSENT AGENDA:
A. Approval of Minutes. CITY CLERK
SUMMARY OF REQUEST: To approve the minutes of the Regular Commission
Meeting that was held on Tuesday, February 26 th •
FINANCIAL IMPACT: None.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Approval of the minutes.
B. Release of Easements within Block 560. ENGINEERING
SUMMARY OF REQUEST: Approve the DMDC's request for the City to release all
easement rights to the vacated alley(s) and streets within block 560 as
described in exhibit A (pg 4) of the documents and authorize the Mayor to sign
the documents. The City had reserved those rights when the streets and alleys
were vacated to provide for future maintenance and upgrades of underground
utilities. Those utilities are no longer active since the construction of the new
downtown street system.
FINANCIAL IMPACT: None.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Approve the release of the easements and
authorize the Mayor to sign the documents.
C. Two-Year Janitorial Services Extension, Through April 30, 2010.
ENGINEERING
SUMMARY OF REQUEST: Extend the current janitorial services contract with
Reliant Professional Cleaning for two more years, one of which is the optional
year that was a port of the original contract solicitation. The current contract
expires April 30, 2008, with on optional 4th year if both parties agreed. The
contractor hod submitted the request which reflects the requested two-year
extension without any cost adjustment from the current year of $49,696 to clean
both City Holl and DPW.
Furthermore, it is requested that the extension, should you approve, needs to
include additional cleaning services at the Filtration Plant at $15,864 annually for
the some contract period as City Holl/DPW.
FINANCIAL IMPACT: The total cost of the contract (City Holl, Police Deportment,
DPW and Filtration Plant) is $69,729.16 annually.
BUDGET ACTION REQUIRED: None, the cost was anticipated during the budget
time.
STAFF RECOMMENDATION: To approve the extension of the contract with
Reliant Professional Cleaning Services to provide cleaning services until the end
of April, 2010, at the three City buildings - City Holl, DPW, and Filtration Plant.
D. Tower Lease with Muskegon Housing Commission. CITY MANAGER
SUMMARY OF REQUEST: To approve a Tower Lease with the Muskegon Housing
Commission that will allow the City to lease space on top of Hartford Terrace to
place communications towers and associated facilities.
FINANCIAL IMPACT: $140/month/antenno.
BUDGET ACTION REQUIRED: None at this time. Appropriate budgets will need to
be amended at a later dote.
STAFF RECOMMENDATION: To approve the agreement and authorize the Mayor
and Clerk to sign it.
E. City-MDOT Agreement to: Amend the Engineering Agreement with
Fleis & Vandenbrink to Increase the Construction Engineering Fee.
ENGINEERING
SUMMARY OF REQUEST: To approve the contract and resolution with MDOT to
amend agreement 06-5195/SA to increase the construction engineering fee to
Fleis & Vandenbrink from $83,000 to $99,900. The increase was the result of the
contractor not completing the job within the completion date as per the
contract.
FINANCIAL IMPACT: None.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Approve the contract amendment and resolution
and authorize the Mayor and Clerk to sign both.
F. Housing Commission Appointments. CITY MANAGER
SUMMARY OF REQUEST: To appoint the following persons to the Muskegon

SUMMARY OF REQUEST: To hold a public hearing on the proposed special
assessment of the Estes Street, Fair Avenue to Lakeshore Drive project, and to
create the special assessment district and appoint two City Commissioners to
the Board of Assessors if it is determined to proceed with the project.
FINANCIAL IMPACT: None at this time.
BUDGET ACTION REQUIRED: None at this time.
STAFF RECOMMENDATION: To create the special assessment district and assign
two City Commissioners to the Board of Assessors by adopting the resolution.
The public hearing opened to hear and consider any comments from the
public. Comments in opposition were heard from Roger and Caughey
Borgeson, 2933 Simmeran Drive, Kalamazoo, reference their property at 2091
Estes: Ray Morency, 2066 Estes, and Derrick Olsen, 2016 Estes. Comments were
also heard from Leland Davis, 1148 Terrace.
Motion by Commissioner Spataro, second by Commissioner Carter to close the
public hearing and table action by Commission to the next Commission
Meeting.

public. Comments in opposition were heard from Ed Winicki, 1826 Crowley, he
owns property on Beidler; David Wotli, 1724 Beidler; and Marion Olejarczyk,
representing 1608 Beidler. Rob Schweifler, 3200 Sandy Ct, owner of two
properties on Beidler spoke in favor.
Motion by Commissioner Spataro, second by Vice Mayor Gawron to close the
public hearing and create the special assessment district for Beidler Street,
Laketon to Southern.

E. Create a Special Assessment District for Roblane Avenue, Quarterline
to Marlane. ENGINEERING
SUMMARY OF REQUEST: Vacate the previously created district on February 12,
2008, and to hold a public hearing on the proposed special assessment of the
Roblane A venue, Quarterline Road to Marlane Street project, and to create a
new special assessment district and appoint two City Commissioners to the
Board of Assessors if it is determined to proceed with the project. The request to
vacate the previously created district is due to:
1. The letters contained an incorrect date for the hearing; the hearing
date was set for February 12, 2008, but the letters listed the date as
February 22, 2008.
2. Calculation errors on parcel 440 and 462 Quarterline. While the
footage on the response cards was accurate, the estimated property
owner cost was not. This was due to multiplication error between the
footage and per foot cost.
FINANCIAL IMPACT: None.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: To vacate the district on Roblane which was
created on February 12, 2008, and to create a new special assessment district
and assign two City Commissioners to the Board of Assessors by adopting the
resolution.
The public hearing opened to hear and consider any comments from the
public. Comments in opposition were heard from Amanda Vandervelde, 463
Marlane.
Motion by Vice Mayor Gawron, second by Commissioner Carter to close the
public hearing and vacate the district on Roblane which was created on
February 12, 2008, and create a new special assessment district for Roblane
Quarterline to Marlane.
ROLL VOTE: Ayes: Wisneski, Carter, Gawron, Spataro, Warmington, and
Wierengo

F. Public Hearing Concerning 2008-CDBG/HOME Recommendation and
Citv Commission Preliminary Decision. COMMUNITY & NEIGHBORHOOD
SERVICES
SUMMARY OF REQUEST: To conduct a public hearing concerning the
CDBG/HOME 2008-2009 recommendation, submitted by both the administration
and the Citizen's District Council. The public hearing is to obtain comments from
the public in reference to the 2008-2009 CDBG/HOME allocation funding which
is designated to be $984,207 and $290,049 respectively, excluding any program
income and reprogrammed funding. The Commission is also asked to make
their preliminary decision on what items should be funded and at what amounts.
The City Commission will be asked to make their final decision on April 8, 2008.
FINANCIAL IMPACT: The 2008-2009 allocations will be based on the City
Commission final decision.
BUDGET ACTION REQUIRED: None at this time.
STAFF RECOMMENDATION: To conduct the public hearing and to make
preliminary allocation decision.
COMMITTEE RECOMMENDATION: The Citizen's District Council
recommendations are included with the recommendations submitted by the
administration.
The public hearing opened to hear and consider any comments from the
public. Comments were heard from Lynette Griffith, 2060 Sullivan Rd., Ravenna,
for Habitat for Humanity; Marcia Hovey-Wright, 452 W. Webster, serve CDBG
Board; Tim Burgess, Neighborhood Investment Corporation; Jeff Melton, 3001
Ninth, advocate for Healthcare; Sheila Krieson, Habitat for Humanity; and Dan
Bonner, 1652 Nelson, Legal Aid of West Michigan.
Motion by Commissioner Carter, second by Commissioner Spataro to close the
public hearing and approve the Citizen District Council recommendations with
changes to the HOME portion from $65,000 to $55,000 for Habitat for Humanity
and Neighborhood Investment Corporation and from $60,000 to $80,000 for Infill
New Construction.
ROLL VOTE: Ayes: Carter, Gawron, Spataro, Warmington, and Wisneski
Nays: Wierengo

G. Recommendation for Annual Renewal of Liquor Licenses. CITY CLERK
SUMMARY OF REQUEST: To adopt a resolution recommending non-renewal of
those liquor license establishments who are in violation of Section 50-146 and 50-
147 of the Code of Ordinances for the City of Muskegon. These establishments
have been found to be in non-compliance with the City Code of Ordinances
and renewal of their liquor licenses should not be recommended by the City
Commission. If any of these establishments come into compliance by March 24,
2008, they will be removed from this resolution, and recommendation for their
renewal will be forwarded to the Liquor Control Commission.
FINANCIAL IMPACT: None.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Adoption of the resolution.
The public hearing opened to hear and consider any comments from the
public. Comments were heard from Attorney Keith McEvoy representing
Community Party Store; Lacy Jones, 245 Eastern, Grand Rapids, and Paul Adam
Billings, 316 Morris Ave. for The Spotlight Nightclub. The following spoke against
the renewal for Kwik-Way, 45 E. Muskegon: Andrew Bickham, 1762 Princess
Lane; Amanda Swarvar, 2849 Bailey; Carol Ripley, l 780 Duchess Court; and Larry
Israel, 1673 Woodside. Additional comments were heard from Dan Krauth, Fox
17.
Motion by Commissioner Carter, second by Commissioner Spataro to close the
public hearing.

resolution recommending non-renewal of those liquor license establishments

2008-27 NEW BUSINESS:
A. Repeal Vehicle for Hire Ordinance. CITY CLERK
SUMMARY OF REQUEST: At a Worksession meeting held on June 11, 2007, the
Commission considered a request to repeal the Vehicle for Hire Ordinance. At
that time, the Commission determined to license taxicabs for one more year
while Muskegon County establish a county-wide licensing requirement. The
Commission indicated they would visit the issue in one year.
The County has determined that they can not offer a county-wide licensing
requirement.
FINANCIAL IMPACT: None.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Staff recommends that the Ordinance to Repeal
Vehicles for Hire, Sections l 02-200 through l 02-260 of the Code of Ordinances
be repealed.
Motion by Commissioner Carter, second by Commissioner Spataro to repeal the
Vehicles for Hire Ordinance.
Motion and second withdrawn.
Motion by Commissioner Carter, second by Commissioner Spataro to extend the
current licensing for cabs to June 11, 2008.

SUMMARY OF REQUEST:
Approve the DMDC's request for the City to release all easement rights to the
vacated alley(s) and streets within block 560 as described in exhibit A (pg 4) of the
attached documents and authorize the mayor to sign the documents. The City had
reserved those rights when the streets & alleys were vacated to provide for future
maintenance and upgrades of underground utilities. Those utilities are no longer
active since the construction of the new downtown street system.

TERMINATION AND RELEASE OF EASEMENT
This TERMINATION AND RELEASE OF EASEMENT
("Termination") is made as of March 11 2008, by the CITY OF
MUSKEGON, a Michigan municipal corporation, of933 Terrace Street, Muskegon,
Michigan 49443 ("City").
RECITALS:
A. DOWNTOWN MUSKEGON DEVELOPMENT CORPORATION, a
Michigan nonprofit corporation (the "DMDC") owns the property located in the City of
Muskegon, Muskegon County, Michigan as set forth in Exhibit A; and this Termination
refers and relates only to the property as defined therein (the "Property").
B. The City has or may have rights and interest in the Property, pursuant to a
certain Easement Agreement for the construction and maintenance of storm sewers,
sanitary sewers, water main and the appurtenances to them, dated September 4, 1974,
recorded in Liber 1045, at Page 111 with the Muskegon County Register of Deeds.
C. The City has or may have reserved and continue to hold rights and interest
in the Property, including utility rights acquired by the City operating in, over and upon
certain streets and alleys formerly located on the Property and vacated by a Resolution
dated December 14, 1971 Alleys in Block 560 Vacated, recorded in Liber 976 at Page 203
with the Muskegon County Register of Deeds.
D. The City has or may have reserved and continue to hold rights and interest
in the Property, including utility rights acquired by the City operating in, over and upon
certain streets and alleys formerly located on the Property and vacated by a Resolution
dated January 8, 1974 Vacating of Streets and Alleys (Phase I) in Downtown Redevelopment
Project R-134 Area, recorded in Liber 1031 at Page 477 with the Muskegon County Register
of Deeds and by a certain Order and Judgment of the Circuit Court for the County of
Muskegon dated 6/24/74 and recorded in Liber 1041, at Page 965 with the Muskegon County
Register of Deeds (the "Order").
E. The resolutions described in Paragraphs B through D above are referred to
herein as the "Resolutions". The easements and other rights and interest of the City
described in Paragraphs B through D above are referred to herein as the "City Easements".
F. The City agrees that there is no active usage of the City Easements, or
sewer or utility rights reserved therein, currently located within the areas identified by the
City Easements.
G. DMDC desires to sell the Property free of all City Easements, and has
requested the City to release the City Easements affecting the Property.
H. The City desires to terminate and release its rights and interests in the City
Easements.
NOW, THEREFORE, for good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, the City hereby agrees to terminate,
discharge, and release all right, title and interest that it may have in the Property,
including, without limitation, all easements or utility rights previously granted to,
acquired by or reserved in favor of the City over, under or upon the Property pursuant to
the Easement Agreement recorded in Liber 1045, at Page 111, the Resolutions recorded
in Liber 976 at Page 203, and Liber 1031, at Page 477, and the Order recorded in Liber
1041, at Page 965, all with the Muskegon County Register of Deeds.
IN WITNESS WHEREOF, this Termination is executed by authorized
representatives of the City on the date above stated.

SUMMARY OF REQUEST:
Extend the current janitorial services contract with Reliant Professional Cleaning for two
more years, one of which is the optional year that was a part of the ori~inal contract

solicitation. The current contract expires April 30, 2008 with an optional 4 year if both
parties agreed. The contractor had submitted the attached request which reflects the
requested two years extension without any cost adjustment from the current year of $49,696
to clean both City Hall & DPW.
Further more, ii is requested that the extension, should you approve, needs to include
additional cleaning services at the Filtration plant at $15,864 annually for the same contract
period as City Hall/DPW.
FINANCIAL IMPACT:
The total cost of the contract (City Hall, P.D, DPW & Filtration Plant) is $69729.16 annually.
BUDGET ACTION REQUIRED:
None, the cost was anticipated during the budget lime.
STAFF RECOMMENDATION:
To approve the extension of the contract with Reliant Professional Cleaning Services to

firm is interested in extending the current janitorial contract for the fourth year of the current
service agreement for both the Public Service Building and City Hall. Likewise, we would
be interested and receptive to providing services to these facilities for a fifth year and honor

mailing address is I 080 Terrace Street, Muskegon, MI 49442, hereinafter refe1Ted to as
"Landowner" and the CITY OF MUSKEGON, a Michigan municipal corporation, whose
address is 933 Terrace Street, Muskegon, MI 49443, hereinafter referred to as "Lessee."
WITNESSETH:
In consideration of the mutual promises contained herein, the patties hereto do hereby covenant,
contract, lease and agree as follows:
ARTICLE 1
PREMISES AND TERM
1. I The Landowner does hereby lease to Lessee, and the Lessee does hereby lease from
Landowner, a certain area of space as more fully set forth and described in Exhibit "A,"
attached hereto and made a part hereof (hereinafter referred to as the "Premises"), said
property situated in the State of Michigan and County of Muskegon.
1.2 Landowner also grants to Lessee the right of ingress and egress 24 hours per day to the
Premises.
1.3 The primary term of this Agreement is for a period of five (5) years from the !st day of
November, 2006, hereinafter the "Primary Term."
1.4 The Lessee shall have five (5) consecutive additional options to renew and extend the
term of this Lease for five (5) years each on the same terms and conditions as contained
in this Agreement except as to rent. Each option shall be deemed exercised by Lessee
unless Lessee notifies Landowner in writing not less than ninety (90) days prior to the
term then in effect that Lessee does not wish to exercise this option.
ARTICLE2
RENT
2.1 Lessee shall pay ground rental under this Lease annually in advance commencing on the
inception date of this Lease and annual thereafter as follows:

ARTICLE3
LANDOWNER'S WARRANTIES
3.1 The Landowner warrants and represents that it is the owner of the Premises and that it
has the full righi, authority and ability to enter into this Lease Agreernent and will
continue to provide adequate power as needed.
Landowner agrees that it and/or any other tenants of the Premises who currently have or
in the future take possession of the Premises will be permitted to install only such
equipment that is of the type and frequency which will not cause material interference
which is measurable in accordance with then-existing industry standards to the then-
existing equipment of Lessee. The parties acknowledge that there will not be an
adequate remedy at law for non-compliance with the provisions of this Article and either
party shall have the right to equitable remedies, including injunctive relief and specific
performance.
ARTICLE4
LESSEE'S USE
4.1 The Lessee agrees to use the Leased Premises only for the purpose of a site or sites for its
communication tower, facilities and equipment used in connection therewith, necessary
and related equipment, tower anchors, the security of its facilities and such other uses
related to the radio towers as well as to maintain or replace and modify any existing
equipmen(during the term of the Lease, or any authorized extension, which it intends to
locate on the Premises. Lessee agrees that ils installation, -operation and 1naintenance
will comply with all applicable rules and regulations of the Federal Communications
Commission and such other Federal, State and Local rules and regulations, including any
zoning regulations, as may be applicable to Lessee's use of the Premises. Should Lessee
be unable to use the Premises for this purpose, Lessee shall have the right to cancel this
Lease, upon reasonable written notice to Landowner, with no further obligation to pay
annual rentals. Lessee is hereby authorized to co-locate a new platform upon an existing
antenna so long as it does not unreasonably interfere with the operation of the electronic
equipment existing at the time.

ARTICLES
IMPROVEMENTS
5. I Landowner agrees that no part of the improvements constructed, erected or placed on the
Premises by Lessee shall be or become affixed to or a part of the Premises, all provisions
and principles of law to the contrary notwithstanding, it being the specific intention of the
Landowner that all improvements of every kind and nature constructed, erected or placed
on the Premises by Lessee shall be and remain the property of the Lessee.
ARTICLE6
END OF TERM
6.1 The Lessee shall at the termination have the right to remove from the Premises all
personai property and iinprove111ents of ev~1y kind and nature placed ther~on by Lessee
within thirty (30) days after termination of this Lease.
ARTICLE7
LIABILITY INSURANCE
7.1 Lessee agrees that it will, at its cost during the term of this Lease, carry and maintain
general public liability insurance against claims for bodily injury and death occurring
within the Premises with reputable and solvent insurance companies authorized to
transact business in the State where the Premises is located and shall provide written
proof that the Landowner has been added as an additional insured on the policy

QUIET ENJOYMENT
8.1 Landowner covenants that so long as the Lessee shall perform and observe all the
covenants, agreements and undertakings of this Lease on the Lessee's part to be
performed and observed, the Lessee shall have quiet, peaceful and uninterrupted
possession, use and enjoyment of the Premises.

NOTICES
9.1 All notices required or permitted hereunder and tender of payment of rental due shall be
considered properly given or made when deposited by Certified or Registered Mail with
the U.S. Postal Service, properly addressed and bearing sufficient postage, but shall only
be considered to be effective when actually received. The addresses of the parties for all

ARTICLE 10
DEFAULT
I 0.1 In the event that Lessee (a) defaults in payment of any rental due hereunder; or (b) fails
to keep or perform any other covenants herein contained; Lessee shall have a period of
thirty (30) days following receipt of written notice from Landowner of the nature of such
default within which to correct such default. If Lessee fails to take steps to correct such
default within said thirty (30) day period, Landowner shall have the right at its option to
( a) cancel this Lease in accordance with law, or (b) proceed one or more times for past
due installments or rental without prejudicing its rights to proceed later for remaining
installments or (c) have recourse to any other remedy to which Landowner may be
entitled by law.
IO .2 In the event that the Lessee defaults in any of the warranties or promises contained
herein, Landlord shall have a period of thirty (30) days following receipt of a written
notice from the Lessee of the nature of such default and a timeframe within which to
correct it. If Landowner fails to take steps to correct such default within that period, the
Lessee shall have the right at its option to cancel this Lease and pursue whatever recourse
for any other remedy it may be entitled to by law.
ARTICLE 11
ENTIRE AGREEMEr-iT
11.1 This Lease, together with the signed Exhibits and/or Addendum, embodies the entire
agreement between the parties. There are no promises, terms, conditions or obligations
referring to the modification of this Lease, except in writing, executed by both Lessee
and Landowner with same formalities as this Lease. This Agreement shall be construed
and enforced in accordance with the laws of the jurisdiction of the situs of the Premises,
and shall be binding on the parties, their respective successors and assigns.

THIS AMENDATORY CONTRACT is made and entered into this date of

WHEREAS, the parties to the Amendment have heretofore, by a Contract dated 6/16/06,
hereinafter referred to as "CONTRACT 06-5195/S I" provided for the construction engineering
and financing of that which is hereinafter referred to as the "PROJECT" and is described as

Western Ave. Streetscaping with decorative pavement, street lights & sidewalks between Third
Street & Terrace in the City of Muskegon.
WHEREAS, the REQUESTING PARTY has requested that the PROJECT work of
CONTRACT 06-5195/Sl be revised to allow for additional engineering fee for Fleis &

Vandenbrink (consulting firm) and the PROJECT COST be revised to reflect an increase in the
CE fee from $83,000 to $99,900; and
WHEREAS, the DEPARTMENT and the REQUESTING PARTY having appropriate
authority desire to amend CONTRACT 06-5195/S 1 to provide for the additional construction
engineering fee due to delays by the contractor in the completion of the construction which was
scheduled for September of 2006 but not completed until December of 2006. Contractor was
assessed liquidated damages for the delays.
NOW, THEREFORE, it is hereby agreed by and between the parties hereto that:
1. The third pruty agreement, SUBCONTRACT 06-5195/S 1, for the Construction
Engineering Contract between the City of Muskegon & Fleis & VandenBrink is revised to read
as follows:
The Amount of Subcontract is $99,900.
2. The REQUESTING PARTY waives any and all claims it has or may have against the
DEPARTMENT which arise out of the need to amend CONTRACT 06-5195/Sl.
3. This Amendatory contract shall become binding on the parties hereto and of full force
and effect upon the signing thereof by the duly authorized officials for the parties hereto; upon
the adoption of the necessary resolution approving said contract and authorizing the signatures
thereto of the respective officials of the REQUESTING PARTY, a ce1tified copy of which
resolution shall be attached to this contract.

Resolution At First Hearing Creating Special Assessment District

Location and Description of Properties to be Assessed:

RECITALS:
1. A hearing has been held on March 11, 2008 at 5:30 o'clock p.m. at the Cily Commission Chambers.
Notice was given by mail and publication as required by law.
2. That estimates of costs of the project, a feasibilily report and valuation and benefit information are on file
with the City and have been reviewed for this hearing.
3. At the hearing held March 11, 2008, there were 11. 91 % objections by the owners of the pl'Operty in the
district registered at the hearing either in writing received before or at the hearing or by owners or agents
present at the hearing, and the Commission has considered the advisability of proceeding with the project.
FINDINGS:
I. The City Commission has examined the estimates of cost to construct the project including all assessable
expenses and determines them _to be reasonable.
2. The City Commission has considered the value of the property to be assessed and the value of the benefit to
be received by each property proposed to be assessed in the district after the improvements have been
made, The City Commission determines that the assessments of costs of the City project will enhance the
value of the properties to be assessed in an amount at least equivalent to the assessment and that the
improvement thereby constitutes a benefit to the property.
THEREFORE, BE IT RESOLVED:
1. The City Commission hereby declares a special assessment district to include the property set forth in
Exhibit A attached to this resolution.
2. The City Commission determines to proceed with the improvements as set forth in the feasibility study and
estimates of costs, and directs the City Engineer to proceed with project design, preparation of
specifications and the bidding process. If appropriate and if bonds are to be sold for the purposes of
financing the improvements, the Finance Depa1tment shall prepare plans for financing including
submission of application to the Michigan Department of Treasury and the beginning of bond proceedings.

3. The City Commission hereby appoints a Board of Assessors consisting of City Commissioner
Shepherd and Mayor Warmington and the City Assessor who are
hereby dfrected to prepare an assessment roll. Assessments shall be made upon front foot basis.
4. Based on the City's Special Assessment policy and preliminary estimates it is expected that approximately
19% of the cost of the street improvement will be paid by special assessments.
5, Upon submission of the special assessment roll, the City staff is hereby dir~cted to notify all owners and
persons interested in properties to be assessed of the hearing at which the City Commission will consider
confirmation of the special assessment roll.

ENGINEERING FEASIBILITY STUDY

The proposed resurfacing oflsabella Ave. between Ambrosia St. & Williams St., see attached special assessment
district map, was initiated by the City due to the street conditions. We feel that resurfacing is the most effective
method especially with the needs for other utilities work such as water & sewer that will enable us to remove the
entire asphalt surface and repave that section while salvaging the existing curb & gutter.
A memorandum from the Assessor's office, which addresses appraisal and benefits to abutting properties, is
attached.
The preliminary cost estimate for the work associated with paving is approximately $140,000.00 with the length of
the project being approximately 1,091 lineal feet or 1,477.5 feet of assessable front footage. This translates into an
estimated improvement cost of$95.00 per assessable foot. However, based on the 2008 assessment figure for this
type of improvement, the assessment will not exceed $17.15 per assessable foot.

District 7 district entailing the reconstruction ofisabella Avenue from Ambrosia Street to

Williams Street (Project# H-1633). The purpose of this analysis is to document the
District2 reasonableness of this special assessment district by identifying and quantifying any

The total estimated cost of the street portion of the project is-$140,000, of which,
approximately 19.0% ($25,339.13) will be paid by property owners through special
assessment. Your property's estimated share ·of the-special assessment is shown on

The street special assessment, which covers improvements to the roadway, may be
paid in installments over a period 0f up to ten (10) years. Any work on.drive approaches

The City of Muskegon is asking for your support for Improvement of the street adjoining your
property located at
The City of Muskegon believes that by making the proposed street Improvements you wlll
have less road noise, dust, and wear and tear on your vehicle. In addition, street
Improvements provide easier access for delivery of services such as snow plowing and mail
delivery.
Called a special assei;sment district, the largest percentage of the proposed street
improvement will be paid for by the City of Muskegon (via local funds and or grants); however,
it will be necessary for you to cover a share of the cost (which you can spread over a period of
ten years) based on the amount of prop~rty you own bordering the street. A description of the
project, including the associated cost to you and the City, is located in the documents
attached to this letter.

Assessments may be paid in full within sixty (60) days of the confirmation of the special assessment roll

Assessments not paid within the first sixty (60) days may be paid In Installments over several years as follows:
Street and Al(ey Assessments - Ten (10) years equal annual principal payments. For example, if the
amount of your assessment ls $850.00, you will be billed $85.00 per year plus applicable interest as
described below.
Driveway, Sidewalk, and Approech Assessments - Ten (10) years equal annual principal payments
plus applicable Interest as described below. ·
Interest- Sim pie interest is charged at the rate of 5.00% per year unless the City has borrowed money
to complete the project for which you are assessed and has pledged you assessments for repayment of
the borrowed money. In suc)'l cases, the interest you are charged is equal _to the Interest rate the City

• Be' 65 years or older or be totally or permanently disabled.
• Have been a Michigan resident for five (5) years or more and have owned and occupied the· homestead
being assessed for five (5) years or more.
• Be a citizen of the U.S.
• Have a total household Income not in excess of $16,823.00
• Have a special assessment of $300.00 or more. .
: Under this program the State of Michigan wlll pay the entire balance owing of the special assessment,
including delinquent, current, :and further Installments. At the time of payment a lien will be recorded on your •
property In favor of the State of Michigan. Repayment to the State must be made at the time the property Is
sold or transferred or after the death of the owner(s). During the time the $peclal assessment Is deferred
interest ls accrued at the rate of 6.00% per year.

program. City ordinances require that property owners be responsible for the repair/replacement of damaged or unsafe
sidewalks adjoining their properties. To assist homeowners, who. may have difficulty paying the cost of sidewalk
repairs, the City offers assessment waivers through the Community Development Block Grant (CDBG) Program for
eligible households and families. If you meet the CDBG program qualifications, the City may pay the street assessmen
for you to the extent that funds are available.

RECITALS:
I. A hearing has been held on March 11, 2008 at 5:30 o'clock p.m. at the City Commission Chambers.
Notice was given by mail and publication as required by law.
2. That estimates of costs of the project, a feasibility report and valuation and benefit information are on file
with the City and have been reviewed for this hearing.
3. At the hearing held March 11, 2008, there were 32 • 77 % objections by the owners of the property in the
district registered at the hearing either in writing received before or at the hearing or by owners or agents
present at the hearing, and the Commission has considered the advisability of proceeding with the project.
FINDINGS:
1. The City Commission has examined the estimates of cost to construct the project including all assessable
expenses and determines them to be reasonable.
2. The City Commission has considered the value of the property to be assessed and the yalue of the benefit to
be received by each property proposed to be assessed in the district after the improvements have been
made. The City Commission determines that the assessments of costs of the City project will enhance the
value of the properties to be assessed in an amount at least equivalent to the assessment and that the
improvement thereby constitutes a benefit to the property.
THEREFORE, BE IT RESOLVED:
1. The City Commission hereby declares a special assessment district to include the property set forth in
Exhibit A attached to this resolution.
2. The City Commission determines to proceed with the improvements as set'forth in the feasibility study and
estimates of costs, and directs the City Engineer to proceed with project design, preparation of
specifications and the bidding process. If appropriate and if bonds are to be sold for the purposes of
financing the improvements, the Finance Department shall prepare plans for financing including
submission of application to the Michigan Department of Treasury and the beginning of bond proceedings.

3. The City Commission hereby appoints a Board of Assessors consisting of City Commissioners

4. B~_ed on the City's Special Assessment policy and preliminary estimates it is expected that approximately
l:~%1 of the cost of the street improvement will be paid by special assessments.
5. Upon submission of the special assessment roll, the City staff is hereby directed to notify all owners and

The reconstruction of Beidler Street between Laketon & Southern, see attached exhibit, was initiated by the City
due to the conditions of the pavement and underground utilities. The existing pavement has deteriorated to a level
where, we believe, a total reconstruction is necessary. This section of road has not had, to the· best of our records,
any major work since it's resurfacing back in 1929 and has an average Pavement Condition Index of!ess than 40.
And as a result of the lack of major work, most of the existing curbs have terrible shape and the drainage facilities
are in need of upgrade. The improvements being proposed, reconstruction, consist of following;
1. Complete removal of existing pavement and replace with a new street section that would include curb & gutter
of and a proposed width of 32' back to back. The proposed width is about a two·foot wider than existing to
accommodate the on street parking along one side of the street.
2. spot repairs on the existing sanitary sewer main
3. Replace existing watermain along with water services
A memo from the Assessor's otlice, which addresses the appraisal and benefit information, is attached.
The preliminary cost estimate for the work associated with paving is approximately $377,000 with the length of the
project being approximately J 600 lineal feet (project length) or 2074 of assessable footage. This translates into an
estimated improvement cost of $178.00 per assessable foot. The assessment figure will be at a cost not to exceed
$32.00 per assessable foot as established in the 2008 Special Assessment for this type of improvement

District 7 distiict entailing the reconstruction of Beidler Street from Laketon Avenue to
Southern Avenue (Project# H-1577). The purpose of this analysis is to document the

accrued benefits. It is subject to the normal governmental restrictions of escheat,

Robert Scolnil< City justly and reasonably represents the accrued benefits to the properties

District 10 property values due to an improved quality oflife created by the proposed project.
Simply stated, the front foot rate of $32.00 to be spread over an assessable footage of
2198.00 for the reconstruction of the above mentioned project area appears reasonable
and equitable based upon the data presented by the City of Muskegon Engineering
Department, and on supporting office records.

The City of Muskegon is asking for your support for Improvement of the street adjoining your

The City of Muskegon believes that by making the proposed street improvements you will

this second hearing the special assessment costs will be spread on the affected

Estimated Costs
The total estimated cost of the street portion of the project is $377,000, of which,
approximately 18% ($67,696.00) will be paid by property owners through special
assessment. Your property's estimated share of the special assessment Is shown on
the attached hearing response card. The remaining costs will be paid by the City,
The street special assessment, which covers improvements.to the roadway, may be
paid in installments over a period of up to ten (10) years. Any work on drive approaches
or sidewalks wlll be assessed to the property at actual contract prices and these costs
may also be paid in installments ovet ten (10) years. Please note this work Is in
addition to the street special assessment.

more information on the payment options and financial assistance programs available.

Special Assessment Payment Options ·
Property owners In the City of Muskegon who are being specially assessed for street, sidewalk or other public
improvements may pay their aaeeBBment In the following ways:
I. Lump Sum Payment In Full
Assessments may be paid in full within sixty (60) days of the confirmation of the special assessment roll
without interest.
II, Installment Payments .
Assessments not paid within the first sixty (60) days may be paid in installments over several years as follows:
Street and Alley Assessments - Ten (10) years equal annual principal payments. For example, If the
amount of your assessment is $850.00, you will be billed $05.00 per year plus applicable Interest as
.described below.
Driveway, Sidewalk, and Approach Assessments - Ten (10) years equal annual prir:ictpal payments
plus applicable Interest as described below.
Interest- Simple interest is charged at the rate of 5. 00% per year unless the City has borrowed money
to complete the project for which· you are assessed and has pledged you assessments for repayment of
the borrowed money. In such cases, the Interest you are charged is equal to the Interest rate the City
must pay on the borrowed money plus 1.00%.
Ill. Special Assessment Deferral (Low Income Seniors and Disabled Persons)
To qualify for a special assessment deferral you or your spouse (if jointly owned) must:
• Be 65 years or older or be totally or permanently disabled.
• Have been a Michigan resident for five (5) years or more and have owned and occupied the homestead
being assessed for five (5) years or more.
• Be a citizen of the U.S.
• Have a total household Income not in excess of $16,823.00
• Have a special assessment of $300.00 or more.
Under this program the State of Michigan will pay the entire balance owing of the special assessment,
including clellnquent, current, and further installments. At the time of payment a lien will be recorded on your
property in favor of the State of Michigan. Repayment to the State must be made at the time the property is
sold or transferred or after the death of the owner(s). During the time the special assessment is deferred
interest Is accrued at the rate of 6,00% per year.

Further information about any of the above payment options may be obtained by·calllng either the City
Assessor's Office at 724-6708 or the City Treasurer's Office at 724-6720. Applications may be obtained at
the Muskegon County Equalization Offica in the Muskegon County building or City· of Muskegon Assessor's
Office in. City Hall. ·
v. Additional Special Asseswent Payment Assistance
Qualified low and moderate income homeowners who are being assessed may be eligible for payment
assistance through the City of Muskegon Community Development Block Grant (CDBG) Program. Assistance
from this program will be available to the extent that funds are available. To obtain further information and
determine whether you are ellglble, contact the Community and Neighborhood Services Department at
724-6717.

RECITALS:
I. A hearing has been held on March 11, 2008 at 5:30 o'clock p.m. at the City Commission Chambers.
Notice was given by mail and publication as required by law.
2. That estimates of costs·of the project, a feasibility report and valuation and benefit information arc on file
with the City and have been reviewed for this hearing.
3. At the hearing held March 11, 2008, there were 25 • 75 % objections by the owners of the property in the
district registered at the hearing either in writing received before or at the heating or by owners or agents
present at the hearing, and the Commission has considered the advisability of proceeding with the project.
FINDINGS:
1. The City Commission has examined the estimates of cost to construct the project including all assessable
expenses and determines them to be reasonable.
2. The City Commission has considered the value of the property to be assessed and the value of the benefit to
be received by each property proposed to be assessed in the district after the improvements have been
made. The City Commission determines that the assessments of costs of the City project will enhance the
value of the prope1ties to be assessed in an amount at least equivalent to the assessment and that the
improvement thereby constitutes a benefit to the property.
THEREFORE, BE IT RESOLVED:
l. The City Commission hereby declares a special assessment district to include the property set fotth in
Exhibit A attached to this resolution.
2. The City Commission determines to proceed with the improvements as set forth in the feasibility study and
estimates of costs, and directs the City Engineer to proceed with project design, preparation of
specifications and the bidding process. If appropriate and if bonds are to be sold for the pmposes of
financing the improvements, the Finance Department shall prepare plans for financing including
submission of application to the Michigan Department of Treasury and the.beginning of bond proceedings.
3. The City Commission hereby appoints a Iloard of Assessors consisting of City Commissioners
Carter and Wierenga · and the City Assessor who are
hereby directed to prepare an assessment roll. Assessments shall be made upon front foot basis.

4. Based on the City's Special Assessment policy and preliminary estimates it is expected that approximately
31.3% of the cost of the street improvement will be paid by special assessments.
5. Upon submission of the special assessment roll, the City staff is hereby directed to notify all owners and
persons interested in p1'operties to be assessed of the hearing at which t}J.e City Commission will consider
confirmation of the special assessment roll.

The proposed reconstruction ofRoblane Ave. between Quaiterline & Marlane St., see attached special assessment
district map, was initiated by the City due to the conditions of the road and drainage. We feel that reconstruction is
the most effective method especially with the needs for other facilities such as storm. sewer system in that area.
The existing pavement condition of 3 5 (out of 100) is well bel,ow acceptable.
The proposed reconstruction consists of existing pavement removal, constructing a new curb & gutter street & new
storm sewer system.
A memorandum from the Assessor's office, which addresses appraisal and benefits to abutting properties, is
attached.
The preliminai·y cost estimate for the work associated with paving is approximately $80,000.00 with the length of
the project being approximately 510 lineal feet or 782.1 feet of assessable front footage. This. translates .into an
estimated improvement cost of $102 per assessable foot. However, based on the 2008 assessment figure for this
type of improvement, the assessment will not exceed $32.00 per assessable foot.
While the preliminary proposed assessment rate on the resolution is 31.3%, the actual rate, upon completion of the
project and at the time of spreading, will be limited to the 25% of total cost as amended in the special assessment
policy

District 8 money to be spread to the 5 property owners has been estimated at $25,027.20 or
Kenneth Mahoney 31.3% of the total costs. The proposed front foot rated to be spread is $32.00. The.
District 1 City's Engineering Department is solely responsible for these figures.

The City of Muskegon has selected your neighborhood and your property for its comprehensive sidewalk
replacement program. City ordinances require that property owners be responsible for tl1e
repair/replacement of damaged or unsafe sidewalks adjoining their propetties. To assist homeowners,
who may have difficulty paying the cost of sidewalk repairs, the City offers assessmeni waivers through
the Community Development Block Grant (COBO) Program for eligible households and families. If you
meet the COBO program qualifications, the City may pay the street assessment for you to the extent that
funds are available.

SUMMARY OF REQUEST: To conduct a public hearing concerning the
CDBG/HOME 2008-2009 recommendation, submitted by both the
administration and the Citizen's District Council.
The public hearing is to obtain comments from the public in reference to
the 2008-2009 CDBG/HOME allocation funding which is designated to
be $984,207 and $290,049 respectively, excluding any program income
and reprogrammed funding.
The Commission is also asked to make their preliminary decision on
what items should be funded and at what amounts.

Licenses
SUMMARY OF REQUEST: To adopt a resolution recommending non-
renewal of those liquor license establishments who are in violation of
Section 50-146 and 50-14 7 of the Code of Ordinances for the City of
Muskegon. These establishments have been found to be in non-
compliance with the City Code of Ordinances and renewal of their liquor
licenses should not be recommended by the City Commission. If any of
these establishments come into compliance by March 24, 2008, they will
be removed from this resolution, and recommendation for their renewal
will be forwarded to the Liquor Control Commission.

whereas, the attached business establishments in the City of Muskegon have liquor
licenses and are found to be in violation of Article V, Section 50-146 and 50-147 of the
Code of Ordinances of the City of Muskegon:
AND WHEREAS, a hearing was held on March 11, 2008, before the City Commission to
allow such licensees an opportunity to refute the determination of the City Commission
that such establishments are in non-compliance with the City Code of Ordinances and
renewal of their liquor licenses should not be recommended by the City Commission; and
WHEREAS, an affidavit of mailing of Notices of Hearing and Notification of Non-
Compliance to City Standards to the licensees has been filed;
NOW, THEREFORE, BE IT RESOLVED, that the City Commission of the City of
Muskegon hereby recommends that these liquor licenses not be approved for renewal,
and a copy of this Resolution be sent to the State Liquor Control Commission. If any of
these establishments come into compliance before March 24, 2008, they will be removed
from this Resolution.

LIQUOR LICENSE
AT 45 E MUSKEGON
WHEREAS, the Muskegon City Commission held a public hearing for the annual renewal of
liquor licenses on Tuesday, March 11, 2008; and
WHEREAS, on December 12, 2007 Jonathan Neiger-Bickham was driving the car that collided
with a tanker truck at M-120 and Old Orchard Lane; and
WHEREAS, Johnathan Neiger-Bickham, age 19, has plead guilty to three felony counts of
drunk driving and has been sentenced 7 to 15 years for the deaths of his passengers,
Shawn David Huq, age 16, Aaron Lee Pham, age 16, and Terry Antonio Ripley, age 19;
and
WHEREAS, it is alleged that all four minors purchased alcohol from Kwik:-Way, 45 E
Muskegon, Muskegon, MI 49440 on two occasions that day;
NOW THEREFORE BE IT RESOLVED that the Muskegon City Commission recommends
non-renewal of the liquor license at Kwik-Way, 45 E Muskegon, MI 49440 in the event it
is determined that the establishment is found to have committed a liquor license violation
in conjunction with the incident stated above.

SUBJECT: Liquor License Renewals
I have reviewed the current list of license holders within the city. Based upon my review, I am
requesting that the city commission not approve the renewal of liquor licenses for the following
businesses: The Spotlight, 441 West Western and the Community Market, 1149 Wood Street. I
offer the following as support for my request.
The Spotlight opened in July, 2007. I have reviewed the police calls for service for this
establishment. During the period 07-01-07 through 01-10-08, we responded to 24 calls
involving disorderly conduct, a variety of assaults and on two occasions, weapons offenses. A
summary of the calls is attached. A number of the calls involved large groups of people fighting
in the street outside of the establishment. On one occasion, as officers responded to a large fight
inside of the building, the doors leading into the bar were pulled closed and locked as the officers
attempted to enter. Both the city manager and I met with the owner of the bar during the late
summer and shared with him our concerns as to the behavior in and near the establishment. He
told us that he would make certain that conditions would improve. They have not.
During the calendar year of 2007, officers responded to 106 calls for service at the Community
Market, which is located at 1149 Wood Street. I have attached a memorandum which was
developed by Detective Dykman and breaks down the calls for service. At the time that this
license was approved some years ago, the owners told us that we, as a community, would see a
vast improvement at this location. Clearly, we have not. This establishment is a drain on police
resources and this comer requires almost constant attention from the district car, the
neighborhood officer and the neighborhood response officers. You should also be aware that we
have received a request for a license transfer from the current owners to a new owner who
resides in Southfield, Michigan. This is a concern as well. In my opinion, allowing a licensed
liquor establishment to exist at this location will only continue to drain police resources and to
prevent any positive activity from occurring in that portion of the Wood Street corridor.

TO WHOM IT MAY CONCERN
This letter is to make very clear my concerns regarding the liquor license renewal
for the Quik Way and Sam's Drink All.
On December 12, 2007 alcohol was purchased at least two different times by two
different minors - Jonathan Chadwick "Chad" Neiger-Bickham and Terry Ripley,
both 19 years old at the Quik Way. This was not the first time that alcohol had
been purchased there. They were not carded since they have bought alcohol
there many times before and were known to at least two of the clerks. Seems
the only requirement was that the kids have a car and was not walking. Is that
understood - not that they be the legal age of 21 years old but that they have a
car - minors in a car, driving with alcohol.
Later that night, Chad, driving drunk, turned in front of a loaded gasoline truck.
Three young men died. THREE. My son Shawn David Huq, 16 years old,
Aaron Pham, 16 years old and Terry Ripley, 19 years old. Chad has been
sentenced to 7 year -15 years in prison. The clerks that knowingly sold alcohol
to the minors and the store owner/manager should also be charged and sent to
prison. They are also responsible. They broke the law and 3 young men died.
After the horrible accident, so many kids (under 21 years of age) have come
forward to family members and the sheriffs department and made statements
that they have bought alcohol from both of these stores without a problem, before
the accident and even more horrendous AFTER the accident. The only
requirement is still - do you have a car, not show me your photo ID to verify that
you are indeed, 21 years old. Many complaints have been made against this
store. My understanding is the store is still under investigation.
WHY IS THIS STORE STILL OPEN AND STILL SELLING ALCOHOL TO
MINORS?????? WHY DOES IT STILL HAVE A LIQUOR LICENSE?????
HOW MANY MORE KIDS HAVE TO DIE????
There are no words to clearly express the heartbreak and grief that the three
families have suffered because of this accident. It is barely three months after
the accident and our lives changed forever. We are not yet so organized but in
the future, I want us to be to any store that sells alcohol to minors THEIR
WORST NIGHTMARE! We can't bring back our boys but we can stop stores
from selling to minors. I ask the owner, is our sons lives worth the few dollars he
made on the sale of alcohol???? Did that help his profit bottom line???

RE: Repeal Vehicle for Hire Ordinance
SUMMARY OF REQUEST: At a Worksession meeting held on June 11,
2007, the Commission considered a request to repeal the Vehicle for Hire
Ordinance. At that time, the Commission determined to license taxicabs for
one more year while Muskegon County establish a county-wide licensing
requirement. The Commission indicated they would visit the issue in one year.
The County has determined that they can not offer a county-wide licensing
requirement.
FINANCIAL IMPACT: None.
STAFF RECOMMENDATION: Staff recommends that the Ordinance to
Repeal Vehicles for Hire, Sections 102-200 through 102-260 of the Code of
Ordinances be repealed.
