MINUTES
The Regular Commission Meeting of the City of Muskegon was held at City Hall,
933 Terrace Street, Muskegon, Michigan at 5:30 p.m., Tuesday, September 11, 2007.
Mayor Warmington offered condolences to the family of Kevin Davis. The
meeting opened with a moment of silence in remembrance of 9-11, and prayer
from Reverend Dennis Remenschneider from St. Paul's Episcopal Church after
which the Commission and public recited the Pledge of Allegiance to the Flag.
ROLL CALL FOR THE REGULAR COMMISSION MEETING:
Present: Mayor Stephen Warmington, Vice Mayor Stephen Gawron,
Commissioners Sue Wierengo, Chris Carter, Clara Shepherd, and Lawrence
Spataro, City Manager Bryon Mazade, City Attorney John Schrier, and City Clerk

2007-76 CONSENT AGENDA:

SUMMARY OF REQUEST: To approve the minutes of the Regular Commission

B. SECOND READING: Rezoning Request for Property located at 1221 W.
Laketon Avenue. PLANNING & ECONOMIC DEVELOPMENT
SUMMARY OF REQUEST: Request to rezone the property located at 1221 W.
Laketon Avenue, from R-1, One Family Residential District to RM-2 Medium Density
Multiple Family Residential District.
FINANCIAL IMPACT: None.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Staff recommends approval of the request.
COMMITTEE RECOMMENDATION: The Planning Commission recommended
approval of the request at their August 16 th meeting. The vote was unanimous,
with J. Aslakson and S. Warmington absent.
C. Meter Reading Radio Equipment Purchase. PUBLIC WORKS
SUMMARY OF REQUEST: Approval to purchase 400 Radio Transceiver units.
Currently the City manually reads 2,000 residential meter pits throughout the City.
This proposal is intended to begin the process of installing radio read technology in
our residential meter pits. The purchase of the remaining 1600 Radio Transceivers is
included in the 2008 Budget.
FINANCIAL IMPACT: Total Cost $44,000.
BUDGET ACTION REQUIRED: None, the proposed 3rd Quarter Budget Reforecast
includes funding for this purchase.
STAFF RECOMMENDATION: To approve the purchase from ETNA SUPPLY.
D. Request to Amend Encroachment Agreement #2000-112(j).
ENGINEERING
SUMMARY OF REQUEST: AMEC/CSX is requesting your permission to amend
agreement #2000- l l 2(j) to install one (l) additional monitoring well in the public
right-of-way of E. Western & Marquette bringing the total to five (5) wells at that
location. The request was made through an encroachment agreement form and
letter.
FINANCIAL IMPACT: None.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: To approve the encroachment agreement subject to
the supplemental conditions.
E. Engineering Services Agreement for Traffic Signals at Marquette and
Harvey/Broadmoor. ENGINEERING
SUMMARY OF REQUEST: Authorize staff to enter into an engineering services
agreement with Wade Trim Inc. out of Grand Rapids to perform the construction
engineering services (inspection) on this federally funded project. Wade Trim's
services are necessary due to lack of experienced staff's availability at this time.
FINANCIAL IMPACT: The charges will be on a per hour rate for a not to exceed of
$9,900.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Authorize staff to enter into an agreement with Wade
Trim Inc.
F. Appointment to the Leisure Services Board. COMMUNITY RELATIONS
SUMMARY OF REQUEST: The Muskegon Public School Board has requested that
Charles Nash be named to the Leisure Services Board. The term will expire January
31, 2009.
FINANCIAL IMPACT: None.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Staff recommends approval.
Motion by Commissioner Carter, second by Commissioner Wierengo to approve
the Consent Agenda as read.

2007-77 PUBLIC HEARINGS:
A. 2008 Budget. FINANCE
SUMMARY OF REQUEST: This is the time set for a public hearing on the City's
proposed budget for the year 2008. The proposed budget has been made
available for public inspection at City Hall, Hackley Public Library and the City's
website (www.shorelinecity.com). After hearing public comments, the City
Commission may take action to adopt the 2008 budget with whatever changes or
adjustments it deems necessary. In any event, City Charter requires the budget be
adopted no later than September 25, 2007.
FINANCIAL IMPACT: The budget sets forth the priorities and overall financial plan
for operations in the year 2008. As proposed, the budget includes no property tax
increase.
BUDGET ACTION REQUIRED: Adoption of the budget resolution provides the legal
appropriation authority necessary for City departments to conduct operations in
2008.
STAFF RECOMMENDATION: After receiving comments, close the public hearing
and approve the proposed 2008 City of Muskegon Budget. Also, approval of the
3rd Quarter 2007 Budget Reforecast as shown in the Budget Book is recommended
at this time.
The Public Hearing opened to hear and consider any comments from the public.
Mr. Leland Davis, 1148 Terrace, made comments.
Motion by Vice Mayor Gawron, second by Commissioner Spataro to close the
Public Hearing and approve the Jrd Quarter 2007 Budget Reforecast and take
action on the 2008 Budget at the September 25th meeting.
ROLL VOTE: Ayes: Carter, Gawron, Shepherd, Spataro, Warmington, and Wierengo
Nays: None

B. Create a Special Assessment District for Clay Avenue, Third to Terrace.
ENGINEERING
SUMMARY OF REQUEST: To hold a public hearing on the proposed special
assessment for the Clay Ave., Third St. to Terrace St. paving project, and to create
the special assessment district and appoint two City Commissioners to the Board of
Assessors if it is determined to proceed with the project.
FINANCIAL IMPACT: None at this time.
BUDGET ACTION REQUIRED: None at this time since the actual construction of this
project, if the district is created and the proposed 2008 budget is approved, will
not take place until 2008.
STAFF RECOMMENDATION: To create the special assessment district and assign
two City Commissioners to the Board of Assessors by adopting the resolution.
The Public Hearing opened to hear and consider any comments from the public.
Comments were heard from Father Tom Page, representing St. Mary's Catholic
Church, 239 Clay, turned in their response card. Reverend Dennis
Remenschneider asked for details regarding the timeline.
Motion by Commissioner Carter, second by Vice Mayor Gawron to close the Public
Hearing and create· the special assessment district for Clay Avenue, Third to
terrace. ·

2007-78 NEW BUSINESS:
A. Certification of MERS Representatives. FINANCE
SUMMARY OF REQUEST: The MERS plan document provides that "the governing
body for each municipality shall certify the names of two (2) delegates to the
Annual Meeting. One delegate shall be a member who is an officer of the
municipality appointed by the governing body of the municipality. The other
delegate shall be a member who is not an officer of the municipality, elected by
the member of(ice/employees of the municipality."
FINANCIAL IMPACT: Cost of attending MERS conference in Kalamazoo estimated
to be $700 per person.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Certification of Tim Paul and John Corrigan to be the
City's officer and employee delegates at the MERS annual meeting in Kalamazoo
September 18-20.
Motion by Commissioner Spataro, second by Vice Mayor Gawron to certify Tim
Paul and John Corrigan to be the City's officer and employee delegates at the
MERS annual meeting in Kalamazoo September 18 to 20.

B. Consideration of Bids for Muskegon and Webster Avenues Two-Way
Conversion and Traffic Signal Upgrade (H-1623}. ENGINEERING
SUMMARY OF REQUEST: Award the contract for the Muskegon and Webster
Avenues' Two-Way Conversion and Traffic Signal Upgrade and Traffic Signal
installation to Strain Electric Company out of Grand Rapids, Ml since they were the
lowest responsible bidder with a bid price of $344,662.70.
FINANCIAL IMPACT: The construction cost of $344,662.70.
BUDGET ACTION REQUIRED: The project was initially budgeted at $250,000 and
thus that number needs to be revised.
STAFF RECOMMENDATION: Award the contract to Strain Electric Company.
Motion by Commissioner Spataro, second by Commissioner Carter to approve the
bid for Muskegon and Webster Avenues two-way conversion and traffic signal
upgrade to Strain Electric Company.

2007-79 ANY OTHER BUSINESS: Fundraiser for Chris Jensen.
Motion by Commissioner Shepherd, second by Commissioner Carter to approve
waiving the Leisure Services fees for the fundraiser for Chris Jensen in October,
2007.

Hearing; Case 2007-28: Request to rezone the property at 1221 W. Laketon Avenue from R-1,

STAFF OBSERVATIONS
I. The site is a 5.63 acre parcel that presently contains a building owned and occupied by
Every Woman's Place.
2. The applicant is requesting a rezoning from R-1, One Family Residential, to RM-2,
Medium Density Multiple Family Residential. Presently, the agency is a legal non-
conforming use. The purpose of the rezoning is to allow the agency to expand to
accommodate their growing clientele. Since expansion of a nonconforming use is only
allowed up to expand up to 25%, and then only with Planning Commission approval,
staff recommended that the agency seek a rezoning.
3. The property to the north, south and east are also zoned R-1, and the property to the west
is zoned OSC, Open Space Conservation.
4. The Future Land Use Map shows this property (Sub-Area 6) as "Public/Quasi-Public".
The Master Plan also states: "It is the goal of the Master Plan to retain the mixed-use
character of Sub-Area 6 and to demonstrate how varying land uses may co-exist, as well
as compliment each other."
5. Vice Mayor Steve Gawron sent an e-mail opposing the request, a copy of which is
included in the staff report packet. Also presented to you at last months meeting were
opposing comments from Sean Mullally, 1781 McGraft.
6. After consideration and discussion with the City Attorney, a PUD for this site
doesn't really seem to meet the requirements of the Zoning Ordinance (see page 11
of this staff report that addresses the PUD purpose, particularly paragraph #2).

7. Included in your packet is an opinion from the City Attorney regarding zoning only
a portion of the property which would contain the present building and the new
addition. It seems from this opinion that it is possible, although unusual to do so. If
this is the route that Planning Commission recommends that we take with this
parcel, certain safeguards should be put iu place, such as a survey and separate
property descriptions.

STAFF RECOMMENDATION
Staff recommends approval of the request to rezone the subject properties from R-1, One Family
Residential to RM-2, Medium Density Multiple Family Residential, because the request
conforms to the goals and recommendation of the City's 1997 Master Plan.
DELIBERATION
Criteria-based questions typically asked during a rezoning include:
I. What, if any, identifiable conditions related to the petition have changed which justify
the petitioned change in zoning.
2. What are the precedents and the possible effects of precedent that might result from the
approval or denial of the petition?
3. What is the impact of the amendment on the ability of the city to provide adequate
public services and facilities and/or programs that might reasonably be required in the
future if the petition is approved?

4. Does the petitioned zoning change adversely affect the environmental conditions or value
of the sun-ounding property?
5. Does the petitioned zoning change generally comply with the adopted Future Land
Use Plan of the City?
6. Are there any significant negative environmental impacts which would reasonably
occur if the petitioned zoning change and resulting allowed structures were built such as:
a. Surface water drainage problems
b. Waste water disposal problems
c. Adverse effect on surface or subsurface water quality
d. The loss of valuable natural resources such as forest, wetland, historic sites,
or wildlife areas.
7. Is the proposed zoning change a "Spot Zone"?
a. Is the parcel small in size relative to its surroundings?
b. Would the zoning change allow uses that are inconsistent with those allowed in
the vicinity?
c. Would the zoning change confer a benefit to the property owner that is not
generally available to other properties in the area?
d. A spot zone is appropriate if it complies with the Master Plan.
DETERMINATION
The following motion is offered for consideration:
I move that the request to rezone the property located at 1221 W. Laketon Avenue from R-1,
One Family Residential district to RM-2, Medium Density Multiple Family Residential district,
as described in the public notice, be recommended for (approval/denial) to the City
Commission pursuant to the City of Muskegon Zoning Ordinance, and the determination of
(compliance/lack of compliance) with the intent of the City Master Land Use and zoning
district intent.

Groundwater Monitoring Well Permit Application -Requirements & Conditions
1. Fees and Costs. A one-hundred dollar ($100.00) non-refundable fee is required for processing of this request. At the time
the permit is issued, the permittee shall pay an administrative handling fee of$10.00 per well per year, which fees shall be
deposited in advance for the entire term of this permit.
2. Monitoring Well Installation Requirements:
a. Top of well casing shall be flush-mounted (unless written permission is otherwise granted by the City) and equipped
with a sturdy lockable, water-tight cover. Each monitoring well must be permanently labeled in the field so that it is
readily identifiable, and coincides with the designations provided on the scaled map referenced in Section 2( d) below.
Monitoring well(s) shall be constructed in accordance with generally accepted industry standards.
b. The Permittee shall provide the City with at least 72 hours written advance notice prior to starting work at the site.
c. Permittee must maintain and repair, as necessary, the monitoring well(s) and any associated equipment. Upon
completion of the use of the monitoring well(s), all wells shall be properly abandoned in accordance with current
Michigan Department of Environmental Quality (MDEQ) standards. At least 72 hours advance written notice shall be
given to the City prior to monitoring well abandonment activities. Permittee shall provide the City with a copy of a
monitoring well abandonment report in acceptable form.
d. Following installation of any monitoring wells in accordance with this permit, Permittee shall provide the City with a
scaled map or figure specifically identifying the locations of the monitoring wells. References to the location of wells
shall be measured from permanent monuments, structures, streets and/or intersections.
e. Any costs, expenses, or liability for environmental response or remediation shall be considered as restoration and shall
be the sole responsibility of the Permittee.
f. Permittee warrants and represents that it has all required permits, licenses or approvals from the Michigan Department of
Environmental Quality, or other governmental department or agency with jurisdiction over Permittee's activities.
g. The City reserves the right to require the Permittee to remove all or any well(s) ifin the sole opinion of the City it is
necessary to facilitate other improvements within the right-of-way, with no reimbursement of costs to Permittee or its
contractor.
h. The City and/or its agents are not responsible for any injury or damage caused by Permittee, its contractor, their
representatives, employees, or agents.
i. The Permittee shall provide a copy of the data collected from the monitoring well(s) to the City, upon request.
3. Specifications. All work perfmmed under this permit must be done in accordance with plans, specifications, maps, and
statements filed with and approved by the City, and must comply with the City's current ordinances and specifications on file
with the City of Muskegon.
4. Miss Dig. In all cases, there must be compliance with Public Act No. 53 of 1974 (MCL 460.701 et seq.) regarding the
protection of underground utilities. Call Miss Dig at (800) 482-7171. The Permittee assumes all responsibility for damage to
or interruption of underground utilities.
5. Bond. Before this permit becomes valid, the Permittee must file with the City Clerk a bond, in a form and amount acceptable
to the City at the time the permit is issued. The bond must be posted before any work begins, and must remain in force
during the entire term of the permit and be in such amount sufficient to guarantee to the City the cost of proper monitoring
well abandonment.
6. Insurance. The Contractor shall at all times carry insurance in the following or greater amounts. The insurance shall be
issued by companies acceptable to the City, licensed in the State of Michigan. The City shall be named as additional insured
on policies of liability insurance. The Permittee shall file certificates or policies evidencing such insurance coverage
annually with the City. Insurance policies or certificates shall provide that the City be given thirty (30) days written notice
before a cancellation or change in coverage may occur. Valid insurance coverage, acceptable to the City, shall be maintained
until such time as the monitoring well is properly abandoned.

7. Indemnification. The Perrnittee shall indemnify and hold harmless the City of and from any liability for claims, damages,
costs, expenses, or fees, including any attorney fees, or fines or awards brought against or charged to the City by any person,
firm, or corporation on account of or arising from the privilege hereby granted to the Permittee or the activities of the
Permittee related to the installation, maintenance, repair, or abandonment of monitoring wells. This indemnification
obligation shall include all liabilities for environmental damage or releases of hazardous substances subject to any
governmental or third party action. "Hazardous substance" is defined as any chemical, substance or material constituting a
prohibited or regulated substance under governmental law, rule, statute, or regulations in force at any time, or any substance
with respect to which any present or future federal, state, or local environmental law or governmental agency requires
environmental investigation, monitoring or remediation.

8. Term of Permit. The privilege granted by this permit shall continue for a period of five (5) years from the date of signature.
Renewal payment of appropriate fees shall continue in five (5) year intervals, due on the first day of May, unless terminated
in accordance with Paragraph 11 below.
9. Limitation of Permit. This permit does not relieve the Permittee from meeting applicable Jaws and regulations of other
governmental agencies or departments. The Permittee is responsible for obtaining additional permits or authorizations, as
necessary, which may be required in connection with this work from other governmental agencies, public utilities, private
entities and individuals, including property owners.
JO. Assignment. This permit shall be binding upon the respective heirs, representatives, successors, and assigns of the
Permittee.
11. Permit Revocation or Surrender. The City may cancel and revoke this permit at any time upon giving the Permittee
fourteen (14) days of written notice, with no refund of the fees required in Paragraph I. The Permittee may surrender the
permit hereby granted at any time upon giving the City fourteen (14) days of written notice, with no refund of the fees
required in Paragraph I. Upon the voluntary relinquishment or abandonment of this privilege, or upon cancellation or
revocation thereof by the City, the Permittee shall properly abandon the monitoring well(s) as described in Paragraph 2 and
restore the property at the Permittee's expense and in a manner satisfactory to the City; and in default thereof shall be liable
to the City for any cost, damage, or expense the City may sustain in such restoration.
12. Violation of Permit. In the event the Permittee fails or refuses to conform to any of the terms and conditions of this permit,
the privilege hereby granted shall immediately terminate and become null and void.

SUPPLEMENTAL CONDITIONS
• Grantee shall notify Grantor of the date when the installation of the Wells shall begin and
shall allow the City's representative ample time to inspect the site before construction begins.
• After completion of construction, the City shall be contacted for final
inspection.
• Grantee shall not disturb any installation in the right of way, including utilities of any kind without prior
approval by the City and the affected company.
• Grantee shall use all means necessary, including MISS DIG, to locate and /or have located all
existing utilities in the vicinity of the proposed Wells.
• If deemed necessary by the City due to public improvements, Grantee shall relocate or
remove the wells as directed by the City within 7-days of notification.
• The grantee shall be fully responsible for the maintenance of the wells and any relocation
that might become necessary to facilitate other improvements within the right of way.
• Grantee will not be allowed to close off roadway nor will he be allowed to hinder the
traffic flow without prior approval by the City.

Thank you for the opportunity to submit a proposal to perform the construction engineering
services for the Laketon Avenue and Marquette Avenue Traffic Signal Improvements.
Based on the meeting held on August 8, 2007 with Jill Bossard and Brian Bunker, and
subsequent discussions, we have developed a scope of services to perform the construction
engineering services.
This project entails utilizing a City inspector for all on-site inspection, with Wade Trim
performing all Field Manager administration, project coordination, and technical assistance.
As City of Muskegon staff will be providing the day-to-day on-site inspection and
documenting IDRS, Wade Trim will perform the following services:
• Technical assistance to the City inspector.
• Final inspection and acceptance of the final product.
• Field Manager administration tasks including:

- Preparing progress reports

RE: 2008 Budget Adoption
SUMMARY OF REQUEST: This is the time set for a public hearing on the City's
proposed budget for the year 2008. The proposed budget has been made available
for public inspection at City Hall, Hackley Public Library and the City's website
(www.shorelinecity.com). After hearing public comments, the City Commission may
take action to adopt the 2008 budget with whatever changes or adjustments it deems
necessary. In any event, City Charter requires the budget be adopted no later than
September 25, 2007.
FINANCIAL IMPACT: The budget sets forth the priorities and overall financial
plan for operations in the year 2008. As proposed, the budget includes no property
tax increase.
BUDGET ACTION REQUIRED: Adoption of the attached budget resolution
provides the legal appropriation authority necessary for City departments to conduct
operations in 2008.
STAFF RECOMMENDATION: After receiving comments, close the public
hearing and approve the proposed 2008 City of Muskegon Budget resolution that is
attached. Also, approval of the 3rd Quarter 2007 Budget Reforecast as shown in the
Budget Book is recommended at this time.
COMMITTEE RECOMMENDATION: The Committee of the Whole will review

Re: Lifeguard Costs
When we were discussing the proposed 2008 budget at the work session last
night it was requested that I provide information for what it would cost to
increase lifeguard hours at the Pere Marquette Park beach. I estimate the cost
to be approximately $3,150 per additional hour of service for the entire season.
This is simply costs for additional hours for existing lifeguards and assumes
there will not be any added costs for the Aquatic Director or for supplies, utilities
and clothing.

RECITALS:
1. A hearing has been held on September 11, 2007 at 5 :30 o'clock p.m. at the City
Commission Chambers. Notice was given by mail and publication as required by law.
2. That estimates of costs of the project, a feasibility report and valuation and benefit information
are on file with the City and have been reviewed for this hearing.
3. At the hearing held September 11, 2007 there were 2 • 94 % objections by the owners of the
property in the district registered at the hearing either in writing received before or at the hearing
or by owners or agents present at the hearing, and the Commission has considered the
advisability of proceeding with the project.
FINDINGS:
1. The City Commission has examined the estimates of cost to construct the project including all
assessable expenses and determines them to be reasonable.
2. The City Commission has considered the value of the property to be assessed and the value of
the benefit to be received by each propetiy proposed to be assessed in the district after the
improvements have been made. The City Commission determines that the assessments of costs
ofthe City project will enhance the value of the properties to be assessed in an amount at least
equivalent to the assessment and that the improvement thereby constitutes a benefit to the
property.
THEREFORE, BE IT RESOLVED:
1. The City Commission hereby declares a special assessment district to include the property set
forth in Exhibit A attached to this resolution.
2. The City Commission determines to proceed with the improvements as set forth in the feasibility
study and estimates of costs, and directs the City Engineer to proceed with project design,
preparation of specifications and the bidding process. If appropriate and if bonds are to be sold
for the purposes of financing the improvements, the Finance Department shall prepare plans for
financing including submission of application to the Michigan Department of Treasury and the
beginning of bond proceedings.
3. The City Commission hereby appoints a Board of Assessors consisting of City Commissioners
Shepherd and Gawron and the City Assessor
who are hereby directed to prepare an assessment roll.
4. Based on the City's Special Assessment policy and preliminary estimates it is expected that
approximately 10.24% of the cost of the street improvement will be paid by special assessments.
5. Upon submission of the special assessment roll, the City staff is hereby directed to notify all
owners and persons interested in properties to be assessed of the hearing at which the City
Commission will consider confirmation of the special assessment roll.

ENGINEERING FEASIBILITY STUDY
For
CLAY AVE. AVE., THIRD ST. TO TERRACE ST.
The proposed resurfacing of Clay Ave., Third St. to Terrace St. using the whitetopping method (concrete
surface) was initiated by the City due to the conditions of the road. The proposed resurfacing, we feel, is
the most appropriate method of repairs at this time to prevent the road from deteriorating further to a
point where this method would not be applicable and a costlier a reconstruction option becomes the only
valid one later on. The proposed improvements consist of the removal of 5 inches of existing pavement
and replacing it with concrete surface similar to that done at the intersection of Laketon & Barclay. The
proposed improvements will also include some water main and service work as well.
A memo from the Assessor's office, which addresses the appraisal and benefit information, is attached.
The preliminary cost estimate for the work associated with paving is approximately $400,000 with the
length of the project being approximate 1850 lineal feet or 2341.20' of assessable front footage. This
translates into an estimated improvement cost of $170.85 per assessable foot. The assessment figure
will be at a cost not to exceed $17.50 per front foot.

The total estimated cost of the street portion of the project is $400,000.00 of which approximately

The street assessment, which covers improvements to the roadway, may be paid in installments over a
period ofup to ten (10) years. Any work on drive approaches or sidewalks will be assessed to the
property at actual contract prices and these costs may also be paid in installments over ten (I 0) years.

Property owners In the City of Muskegon who are being specially assessed for street, sidewalk or other public
Improvements may pay their assessment In the follow Ing ways:
I. Lump Sum Payment /11 Full
Assessments may be paid In full within sixty ( 60) days of the confirmation of the special assessment roll
without interest
II. Installment Payments
Assessments not paid within the first sixty (60) days may be paid In Installments over several years as follows:
Street and Alley Assessments- Ten (10) years equal annual principal payments. For example, If tl1e
amount of your assessment Is $850.00, you will be billed $85.00 per year plus applicable Interest as
described below.
Driveway, Sidewalk, and Approach Assessments- Ten (10) years equal annual principal payments
plus applicable Interest as described below.
Interest- Simple lnterest Is charged at the rate of 5.00% per year unless the City has borrowed money
to complete the project tor which you are assessed and has pledged you assessments for repayment of
the borrowed money. In such cases, the Interest you are charged Is equal to the Interest rate the City
must pay on the borrowed money plus 1.00%.
Ill. Special Assessment Deferral (low Income Seniors and Disabled Persons)
To qualify for a special assessment deferral you or your spouse (If jointly owned) must:
• Be 65 years or older or be totally or permanently disabled.
• Have been a Michigan resident for five (5) years or more and have owned and occupied the homestead
belng assessed for five (5) years or more.
• Be a cltize n ol the U.S.
• Have a total household Income not in excess of $16,823.00
• Have a special assessment of $300.00 or more.
Under this program the State of Mlchlgan will pay the entire balance owing of the special assessment,
Including delinquent, current, and fu11her Installments. At the time of payment a lien will be recorded on your
property In favor of the Slate of Michigan. Repayment to the Slate must be made at the time the prope11y Is
sold or transferred or after the death of the owner(s). During the time the special assessment Is deferred
Interest Is accrued at the rate of 6.00% per year.

Dear Resident:
The City of Muskegon has selected your neighborhood and your property for its comprehensive
sidewalk replacement program. City ordinances require that property owners be responsible for the
repair/replacement of damaged or unsafe sidewalks adjoining their properties. To assist homeowners,
who may have difficulty paying the cost of sidewalk repairs, the City offers assessment waivers through
the Community Development Block Grant (CDBG) Program for eligible households and families. If
you meet the CDBG program qualifications, the City may pay the street assessment for you to the
extent that funds are available.
Application Requirements:
✓ Applicants must submit proof that their total household income does not exceed 65% of Area
Median Income (see chart below); Proof of income may include copies of Wage & Tax Statement
(W-2's) from the year 2006, pension or other benefit checks, bank statements for direct deposits or
agency statements for all household income.

Dear Madame/Sir,
I have received the notice of a hearing on a special assessment district to be created for
the Clay Ave/Third St/Terrace St area. It is my understanding that this strip will be
resurfaced and a portion of the cost is to be assigned to the property owners at 297 W.
Clay. As an owner of two condos in this building I have some concerns about the
assessment and unfortunately I will be out of town and unable to attend the public
hearing.
Please allow the following comments to reflect my concerns.
First, I am aware that a major upgrade of the downtown area is taking place. This
upgrade will benefit the entire City not to mention the County. Without further
information, I don't believe a resurfacing of this small strip would take place unless this
drive to upgrade downtown was taking place. I don't believe the actions to resurface this
strip will mean "less noise, dust and wear and tear on my vehicle."
I believe it is patently unfair to charge the few people (36 units at 297 W. Clay) who live
along this strip any portion of this strip beyond what the general populace pays. If
anything the organizations that are driving this development should be paying for any and
all improvements to the infrastructure as is done in other parts of this country. If we are
unable for economic reasons to pass along these costs to the ones who will truly benefit
from infrastructure changes, then trying to penalize disproportionately the small group of
people who appear to be easy victims is wrong.
I will submit a negative vote for this special assessment for both of my units. I'm also
concerned that creating this district may submit 297 W. Clay to a continuing assessment
parade for other whims developers may have down the road.

SUMMARY OF REQUEST: The MERS plan document provides that "the governing body
for each municipality shall certify the names of two (2) delegates to the Annual Meeting. One delegate
shall be a member who is an officer of the municipality appointed by the governing body of the
municipality. The other delegate shall be a member who is not an officer of the municipality, elected by
the member officer/employees of the municipality."
Each City bargaining unit has selected a member to attend the MERS meeting and have agreed to a
rotating system (based on date of joining MERS) to select an official employee representative. This
year the employee representative will be John Corrigan from the Police Patrol unit.
FINANCIAL IMPACT: Cost of attending MERS conference in Kalamazoo estimated to be
$700 per person.
BUDGET ACTION REQUIRED: None.
STAFF RECOMMENDATION: Certification of Tim Paul and John Corrigan to be the
City's officer and employee delegates at the MERS annual meeting in Kalamazoo September 18-20.

Ml. since they were the lowest responsible bidder with a bid price of $344,662.70.

The construction cost of $344,662.70
BUDGET ACTION REQUIRED:
The project was initially budgeted at $250,000 and thus that number needs to be revised.

Dear Mr. AI-Shatel:
We have reviewed and tabulated the two (2) bids received for the above mentioned project
on September 5, 2007. Bids ranged from $344,662.70 to $355,828.07. The engineer's
opinion of cost was $336,481.25. Please find a copy of the tabulated bids enclosed for your
review.
Based on the enclosed information, we recommend that the City award the contract to the
low bidder, Strain Electric Co. for the bid price of $344,662.70. The final Notice to Proceed
will be issued by the City to the contractor after the completed agreement, bonds, and
insurance documents are submitted by the contractor.
