MINUTES The Regular Commission Meeting of the City of Muskegon was held at City Hall. 933 Terrace Street, Muskegon, Michigan at 5:30 p.m., Tuesday, January 24, 2006. Mayor Warmington opened the meeting with a prayer from Reverend Michael Borgert from the First Christian Reformed Church after which the Commission and public recited the Pledge of Allegiance to the Flag. PUBLIC WORKS SUMMARY OF REQUEST: Contract with the Muskegon County Road Commission for the joint purchase of various Traffic Department materials and services. We have bid out these items with the Muskegon County Road Commission for the past sixteen years. By bidding together with the Muskegon County Road Commission and other municipalities, we are able to get better unit prices because of larger quantity purchases. CITY CLERK SUMMARY OF REQUEST: To adopt the amendments to the City of Muskegon Code of Ordinances to reflect changes by City Commission to dissolve the Cemetery Committee and assign the responsibilities to Leisure Services Board. The amendments will repeal Chapter 14 (Cemetery) and amend Chapter 58 (Parks and Recreation). ENGINEERING SUMMARY OF REQUEST: To hold a public hearing on the spreading of the special assessment for Southern Avenue from Sixth to Seaway, and to adopt the resolution confirming the special assessment roll. FINANCIAL IMPACT: A total of $98,204.80 would be spread against the forty-five (45) parcels abutting the project. BUDGET ACTION REQUIRED: None at this time. ROLL CALL: Ayes: Shepherd, Spataro, Warmington, Wierengo, Carter, Davis, and Gawron Nays: None MOTION PASSES 2006-10 NEW BUSINESS: A. FIRST READING: 2006 Parking Fine Adjustments. FINANCE SUMMARY OF REQUEST: Staff proposes the following changes to the City's Parking Ordinance: • Increase in the fine for launching a boat without a permit. The current fine is $17.50 and the cost of a daily permit is $10.00. Some boaters may feel the $7.50 additional cost is sufficiently low to make it worth the risk of launching without a permit. Staff believes that considerable revenue is being lost because of this. We propose increasing the base fine to the cost of an annual launch ramp permit ($55.00) • Increase the base handicap violation fine from $50.00 to $100.00. This will improve handicap parking compliance. The current $50.00 fine is at the low end of the range of fines assessed by area communities: o Grand Haven $50.00 o Grand Rapids $75.00 o Holland $52.00 o Kentwood $100.00 o Norton Shores $50.00 o Walker $100.00 o Wyoming $1 00.00 FINANCIAL IMPACT: Increased compliance with launch ramp permit requirements will increase revenues to the city's Marina & Launch Ramp fund. Increased compliance with handicap parking regulations will result from the increase in this fine category. BUDGET ACTION REQUIRED: None at this time. STAFF RECOMMENDATION: Approval of the recommended increases in parking fines for boat launch and handicap parking violations. PUBLIC SAFETY SUMMARY OF REQUEST: The Director of Public Safety requests that the Commission approve a Memorandum of Agreement between the City and the Muskegon/Muskegon Heights Weed and Seed. This agreement will designate services that the Muskegon Police Department will provide as a member of this collaborative effort. This agreement will be administered within the provisions of the policies and procedures set forth by the Weed and Seed Steering Committee and the United States Department of Justice. FINANCIAL IMPACT: None BUDGET ACTION REQUIRED: None STAFF RECOMMENDATION: Approval of this request. Motion by Commissioner Wierengo, second by Commissioner Carter to approve the Memorandum of Agreement for Weed & Seed. PLANNING & ECONOMIC DEVELOPMENT SUMMARY OF REQUEST: Enter into an engineering services agreement with URS for design engineering for Western Avenue from 3rd Street to 8th Street. URS was the low bidder at a cost of $55,877. FINANCIAL IMPACT: The cost for these services have already been budgeted. BUDGET ACTION REQUIRED: None STAFF RECOMMENDATION: Staff recommends that the City enter into an engineering services agreement with URS for design engineering for Western Avenue from 3rd Street to 8th Street. PUBLIC SAFETY SUMMARY OF REQUEST: This is to request that the City Commission concur with the findings of the Housing Board of Appeals that the structures are unsafe, substandard, a public nuisance and that they be demolished within thirty (30) days. It is further requested that administration be directed to obtain bids for the demolition of the structures and that the Mayor and City Clerk be authorized and directed to execute a contract for demolition with the lowest responsible bidder. City of Muskegon Traffic Department Memo To: Bob Kuhn From: Dan Gomez Cc: Doug Sayles Date: 01-12-06 Re: Sign Materials & Services: Annual Contract Again this year we are requesting permission to bid jointly for our sign materials and services with the Muskegon County Road Commission as we have done the last sixteen years. They are getting ready to go out for bids on the following items and thus we do not have any actual quotes for 2006. For sign blanks: 2002 2003 2004 2005 sign blanks -7 $1.40/sq. ft. $1.34/sq. It For sign posts: 2002 2003 2004 2005 2# x 11' posts -7 $ 6.15/ea. $6.08/ea. $9.24/ea. $10.10 3# x 12' posts -7 $10.08/ea. $9.96/ea. $15.12/ea. $16.53 Steel prices shot up in 2004 52%, considerably increasing cost for sign posts and some increase in aluminum sign blanks. They tapered off in 2005 with a marginal increase. For sheeting: Our standard has always been 3M sheeting, they are the only bid usually received by MCRC, they like us, use 3M sheeting exclusively, however we recently purchased our 3M roller, as did MCRC, and no longer have to buy a minimum order to keep the roller they originally gave to us to maintain the warranty on their sheeting. Other competitive sources are also bidded out. Finished Signs: Most finished signs were purchased through competitive venders, but MCRC is starting to purchase these signs in the bid system for a considerable savings. We have purchased some signs this way the last three years and will continue to do so when purchasing in quantities. • Page 1 Centerline painting: Before 1997, we contracted with the MCRC for this work. In 1997 they sold their equipment and we jointly bid with all other cities and townships in the County. In 1997 M&M Pavement Marking, Inc. was awarded the bid and has since been extended the contract every year since at the same unit prices up until 2004 when a 6% increased incurred to cover rising fuel and material costs. Our overall cost since 1998 has been higher because we painted over significant amounts of faded permanent pavement marking and decided not to put down as much PPM after new construction. Additional criteria for the selection were: I. The need to reduce maintenance cost associated with the upkeep of thin surface coat of asphalt 2. Enhance the appearance of that area 3. improve the drainage facility The combination of the above reasons makes the selection of this street for improvements an ideal one. A memorandum from the Assessor's office, which addresses appraisal and benefits to abutting properties, is attached. The preliminary cost estimate for the work associated with paving is $60,000 with the length of the project being approximately 285 lineal feet (project length) or 296.5'of assessable footage. This translates into an estimated improvement cost of $202.00 per assessable foot. Lump Sum Payment in Full Assessments may be paid in full within sixty (60) days of the confirmation of the special assessment roll without interest. II. Installment Pavments Assessments not paid within the first sixty (60) days may be paid in installments over several years as follows: Street and Alley Assessments- Ten (1 0) years equal annual principal payments. Kundinger, City Clerk 933 Terrace Street, Muskegon, MI 49440 (231) 724-6705 or TDD (231) 724-6773 ENGINEERING FEASIBILITY STUDY For Montgomery St., Laketon Ave. to Sonthern Ave. The reconstruction of Southern between Laketon & Southern, see attached exhibit for location, was initiated by the City and approved for over $315,000 of federal funds due to the conditions of the pavement, drainage facilities and other underground utilities (water & sewer) as well as it's designation as a collector street. The existing pavement has deteriorated to a level where, we believe, a total reconstruction is necessary. This section of road has not had, to the best of our records, any major work since 1957 when it was resurfaced. The proposed improvements (reconstruction) consist of following; I. Complete removal of existing pavement and replace with a new asphalt street section that would include curb & gutter and a proposed width of 32' back to back. 2. Sanitary sewer replacement- spot repairs. 3. Water & Sanitary Services replacement. 4. Storm sewer replacement (drainage facilities) 5. Restrict on street-parking to the westerly side of the street to meet the act-51 requirements. A memo from the Assessor's office, which addresses the appraisal and benefit information, is attached. The preliminary cost estimate for the work associated with paving is $545,777 with the length of the project being approximately 2066lineal feet (project length) or 2898'of assessable footage. This translates into an estimated improvement cost of $188 per assessable foot. The assessment figure will be at a cost not to exceed $32.00 per assessable foot as established in the 2006 Special Assessment Rates for this type of improvement January 91h, 2006 Mohammed Al-Shatel, City Engineer City of Muskegon 933 Terrace Street Muskegon,MI49443 Mr. Al-Shatel: In accordance with your request, I have examined the proposed special assessment district entailing the reconstruction of Montgomery Ave between Laketon Ave and Southern Avenue. The purpose of this analysis is to document the reasonableness of this special assessment district by identifying and quantifYing any accrued benefits. It is subject to the normal governmental restrictions of escheat, taxation, police power and eminent domain. The effective date is January 91h 2006. h1 conclusion, it is my opinion that the special assessment amounts justly and reasonably represents the accrued benefits to the properties encompassed by this project. Lump Sum Payment in Full Assessments may be paid in full within sixty (60) days of the confirmation of the special assessment roll without interest. II. Installment Payments Assessments not paid within the first sixty (60) days may be paid in installments over several years as follows: Street and Alley Assessments- Ten (1 0) years equal annual principal payments. For example, if the amount of your assessment is $850.00, you will be billed $85.00 per year plus applicable interest as described below. Driveway, Sidewalk, and Approach Assessments- Ten (10) years equal annual principal payments plus applicable interest as described below. Upgrades are critical to maintaining our quality of life in Muskegon. However, in the city's latest efforts with the Montgomery road project I find myself somewhat perplexed. In speaking with a number of Montgomery neighbors we share many of the same concerns which include: • Speed control • Lack of adequate parking space • Widening of the street/ impact on the trees • Ruddiman/Montgomery Street traffic circle I am voting "no" on this project, because these issues need to be discussed with area residents prior to city commission approval of this project, in spite of the fact that there is up to $315,000 of grant funds for the road work. Unfortunately, I will be out of town on January 24th 2006. I am asking that my letter be read as part of the public hearing. A hearing has been held on January 24,2006 at 5:30 o'clock p.m. at the City Commission Chambers. Notice was given by mail and publication as required by law. 2. That estimates of costs of the project, a feasibility report and valuation and benefit information are on file with the City and have been reviewed for this hearing. 3. At the hearing held January 24, 2006, there were 27.61% objections by the owners of the prope1ty in the district registered at the hearing either in writing received before or at the hearing or by owners or agents present at the hearing, and the Commission has considered the advisability of proceeding with the project. FINDINGS: I. The City Commission has examined the estimates of cost to construct the project including all assessable expenses and determines them to be reasonable. 2. The City Commission has considered the value of the property to be assessed and the value of the benefit to be received by each property proposed to be assessed in the district after the improvements have been made. The improvement being proposed consists of a complete removal of all existing pavements including curb and gutter and the placement of a new street pavement that will include a new curb and gutter. A memo fi·om the Assessor's office, which addresses the appraisal and benefit information is attached. The preliminary cost estimate for the work associated with paving is approximately $99,000 with the length of the project being approximately 284 lineal feet or 311.50 of assessable front footage. This translates into an estimated improvement cost of $317 per assessable foot. The assessment tigure will be at a cost not to exceed $32.00 per front foot. The purpose of this analysis is to document the reasonableness of this special assessment district by identifying and quantifying any accrued benefits. It is subject to the normal governmental restrictions of escheat, taxation, police power and eminent domain. The effective date is Janumy 9 111 , 2006. In conclusion, it is my opinion that the special assessment amounts justly and reasonably represents the accrued benefits to the properties encompassed by this project. The amounts reflect the sum of the immediate estimated value enhancement and the intrinsic value that will accrue from an overall increase in prope1ty values due to an improved quality of life created by the proposed project. As previously presented, the proposed special assessment district encompasses primarily residential properties. The front foot rate of$32.00 for the new construction of the above mentioned project area appears reasonable in light of an analysis that indicates a possible enhancement of $32.96. Lump Sum Payment in Full Assessments may be paid in full within sixty (60) days of the confirmation of the special assessment roll without interest. II. Installment Payments Assessments not paid within the first sixty (60) days may be paid in installments over several years as follows: Street and Alley Assessments- Ten (1 0) years equal annual principal payments. Lump Sum Pavment in Full Assessments may be paid in full within sixty (60) days of the confirmation of the special assessment roll without interest. II. Installment Pavments Assessments not paid within the first sixty (60) days may be paid in installments over several years as follows: Street and Alley Assessments- Ten (1 0) years equal annual principal payments. A hearing has been held on January 25, 2005 at 5:30 o'clock p.m. at the City Commission Chambers. Notice was given by mail and publication as required by law. 2. That estimates of costs of the project, a feasibility report and valuation and benefit information are on file with the City and have been reviewed for this hearing. 3. The current fine is $17.50 and the cost of a daily permit is $10.00. Some boaters may feel the $7.50 additional cost is sufficiently low to make it worth the risk of launching without a permit. Staff believes that considerable revenue is being lost because of this. We propose increasing the base fine to the cost of an annual launch ramp permit ($55.00) • Increase the base handicap violation fine from $50.00 to $100.00. This will improve handicap parking compliance. The current $50.00 fine is at the low end of the range of fines assessed by area communities: o Grand Haven $50.00 o Grand Rapids $75.00 o Holland $52.00 o Kentwood $100.00 o Norton Shores $50.00 o Walker $100.00 o Wyoming $100.00 FINANCIAL IMPACT: Increased compliance with launch ramp permit requirements will increase revenues to the city's Marina & Launch Ramp fund. Increased compliance with handicap parking regulations will result from the increase in this fine category. BUDGET ACTION REQUIRED: None at this time. Case Tabled 09/27/05 SUMMARY OF REQUEST: This is to request that the City Commission Concur with the findings of the Housing Board of Appeals that the structure located at 291 Washington- Area 10b is unsafe, substandard, a public nuisance and that it be demolished within thirty (30) days. It is further requested that administration be directed to obtain bids for the demolition of the structure and that the Mayor and City Clerk be authorized and directed to execute a contract for demolition with the lowest responsible bidder. On 08/05/04 the HBA declared the structure substandard and dangerous. On 03/22/05 City Commission tabled case to allow owner time to secure permits and complete repairs. Case brought back to City Commission on 08/27/05 and was tabled for another 30 days to allow contractor (owners nephew) to secure permits, and provide timeline to complete repairs. Owner Contact: Mr. Holden was present to represent this case at HBA meeting. He stated he lives at 291 Washington and can start repairs in 30 days. He was given a copy of the interior inspection that was conducted earlier in the week at the HBA meeting. Case scheduled before City Commission on 03/22/05. Mr. Holden appeared before Commission stating he had been ill but had plans to complete repairs. Commission tabled for 30 days. There were no permits issued or inspections scheduled and no owner contact since that time. Case brought back to City Commission 08/27/05 where Mr. Holden was present and stated he planned to have his nephew who was a contractor to pull permits and provide a timeline to complete repairs. Commission tabled case for 30 days. A permit was issued on October 7, 2005 with stipulations exterior repairs to be completed by 11/15/05. The permit was revoked due to check being returned for non-sufficient funds. There have been no inspections scheduled and no owner contact since that time. Case brought back before HBA 09/01/05 and was declared substandard, dangerous and a public nuisance. A request for board up was issued 09/21/05. Owner Contact: Ms. Sylvia Brown (daughter) was present to represent case at the HBA meeting dated 07/13/05 and stated their had been death in the family, then Ms. Sylvesta Brown(mother) was sick and had been hospitalized until June 3, 2005. The house was an inheritance from grandparents. The house could not be maintained due to financial trouble and Ms Silvesta Brown is now in senior housing. Sam Brown (cousin) has tried to help in cleaning up the outside of the home and it appears the home has been vandalized inside. They have tried to contact mortgage company to find out the status of property with no response. The case was tabled for 30 days provided the house was secured and interior inspection scheduled.
