This purchase is a budgeted replacement of an existing unit. We currently have four
Case 580 backhoes in our fleet, but decide it was time to check out the other brands
to see if we where still are getting the best machine for our money. After testing all of
the above units we found none to be any better than are current units. Therefor with
Wolverine Tractor being low bidder, I recommend that we purchase the new unit
from them.

RE: Sale of Non-Buildable Lot in Jackson Hill
SUMMARY OF REQUEST:
To approve the sale of the vacant non-buildable lot designated as map# 24-
31-20-251-009 to Jackson Hill Baptist Church. The lot has 26 feet of frontage
and is located between Wood and Charles Streets. The parcel is being
offered to the church for $100. The church has been maintaining the lot for
the last five years and wishes to legally possess it at this time.
FINANCIAL IMPACT:
The sale of this lot will allow the property to be placed back on the City's tax
rolls thus relieving the City of continued maintenance costs.
BUDGET ACTION REQUIRED:
None.
STAFF RECOMMENDATION:
To approve the attached resolution and to authorize both the Mayor and the
Clerk to sign said resolution.
COMMITTEE RECOMMENDATION:
The sale is consistent with the Jackson Hill Marketing Strategy recommended
by LRC and approved by City Commission.

WHEREAS, Jackson Hill Baptist Church has maintained the non-buildable lot adjacent to their
property for the last five years
WHEREAS, Jackson Hill Baptist Church has paid the $100 for map# 24-31-20-251-009;
WHEREAS, the sale would relieve the City of further maintenance costs;
WHEREAS, the sale is consistent with City policy regarding the disposition of buildable lots;
and the Jackson Hill Neighborhood Strategy;
NOW THEREFORE BE IT RESOLVED, that map# 24-31-20-251-009 be sold to the above-

Hearing; Case 2000-22: Request to rezone property located on vacated Delaware Ave.
(between Ambrosia and Sophia Streets) from RM-1, Low Density Multiple-Family
Residential to B-4, General Business, by Goodwill Industries of West Michigan, Inc.
BACKGROUND
Applicant: Goodwill Industries of West Michigan, Inc.
Location of Subject Property: vacated Delaware Ave., btwn Ambrosia & Sophia Strts
Current Use: Offices/Parking lot
Current Zoning: RM-I, Low Density Multiple-Family Residential
Proposed Zoning: B-4, General Business
STAFF OBSERVATIONS
I. The subject property is currently nonconforming and contains a portion of the Goodwill
Industries main campus, as well as a parking lot.
2. Delaware Ave. has been vacated, so the subject property is all contiguous to the main
Goodwill Industries campus at 271 E. Apple Ave.
3. The Future Land Use Map shows the subject property, as well as the rest of the Goodwill
Industries campus, as Downtown/Lakeshore Redevelopment Area. Since the majority of
the Goodwill Industries campus is already zoned B-4, they are asking to rezone the rest of
their property to be consistent. Staff did discuss rezoning the parking area to a less
intensive commercial district, such as B-2, but they plan to use the area for expansion in
the future and would prefer that all of their property be zoned consistently to avoid
problems with future expansion plans. They currently engage in light industrial assembly
on site, which may also be part of their future expansion.
4. The Goodwill Industries campus is well-designed and well-kept up, and as such helps to
stabilize the Apple Ave. corridor, especially since it is located on the edge of the
downtown area.
5. The Master Land Use Plan shows the Goodwill Industries campus on the border between
two sub-areas, Sub-Area 4 and the core Downtown area. The Master Land Use Plan
states for Sub-Area 4:
• Sub-Area 4 is predominately residential in use... The sub-area also includes a
variety of medical facilities and commercial, industrial, and instituhonal
development ... It is the goal of the Master Plan to retain the residential orientation
of Sub-Area 4, while also recognizing the importance of existing medical, office,

commercial, and industrial development that is appropriately sited and designed.
With the exception ofLaketon Avenue, these latter uses are found along the perimeter
of the sub-area.
6. The Master Plan recommends for this sub-area:
• Maintain the sub-area's residential focus.
• Implement, through zoning, buffer requirements associated with the placement of
non-residential uses contiguous to residential development.
• Implement comprehensive streetscape programs along Apple Avenue, Getty Street,
Laketon Avenue, and Peck Street.
7. The Downtown/Lakeshore Redevelopment Plan shows the Goodwill Industries campus
as being located in the Service Center. The Downtown/Lakeshore Redevelopment Plan
states for the Service Center:
• Government facilities already have a distinct and positive influence on this area, and
this should continue... Other office and professional uses should be encouraged.
Several important law firms reside in this area and similar professional activities
should continue to find a home. Sensitive retail and commercial development should
be encouraged, especially along the mqjor streets. Such uses provide a transition
between the surrounding residential neighborhoods and the other developing
GEMS... Note that the Service Center often acts as a gateway to the Downtown.
ORDINANCE EXCERPTS
ARTICLE VII- RM-I LOW DENSITY MULTIPLE-FAMILY RESIDENTIAL DISTRICTS
PREAMBLE
The RM-I Low Density Multiple Family Residential Districts are designed to provide sites for multiple family
dwelling structures, and related uses, which will generally serve as zones of transition between the
nonresidential districts and the lower density One Family and Two Family Residential Districts, and MHP
Mobile Home Park Districts.
SECTION 700: PRINCIPAL USES PERMITTED
In an RM-I Low Density Multiple Family Residential District no building or land shall be used and no building
shall be erected, structurally altered, or occupied except for one (I) or more of the following specified uses,
unless otherwise provided for in this Ordinance:
I. All Principal Uses Permitted in the R One Family and RT Two Family Residential Districts with the
lot area, yard, and floor area requirements for one (I) and two (2) family dwellings equal to at least the
requirements of the immediately abutting residential district.
2. Multiple dwellings and row houses for any number of families.
3. Accredited fraternity and sorority houses when located not less than twenty (20) feet from any other
lot in any residential district.
4. Tourist homes having not more than two (2) guest rooms provided the premises fronts on a street
which is officially designated as a major thoroughfare or collector thoroughfare.

5. Rooming houses with a capacity of not more than three (3) roomers.
6. Churches and other facilities normally incidental hereto ...
7. Home occupations of a non-industrial nature may be permitted ...
8. Congregate living facility for not more than six persons, provided that such facility shall be at least one
thousand five hundred (1,500) feet from any other similar facility.
9. Adult foster care facility for not more than six persons.
JO. Accessory buildings and accessory uses customarily incidental to the above Principal Permitted Uses.
11. Uses similar to the above Principal Permitted Uses.
SECTION 701: SPECIAL LAND USES PERMITTED
The following uses, and their accessory buildings and accessory uses, shall be permitted under the purview of
Section 2332 after review and approval of the use (and a site plan, if required) by the Planning Commission,
after Public Hearing, subject to the applicable conditions, and any other reasonable conditions imposed by the
Planning Commission:
1. Offices and clinics of physicians, dentists, architects, engineers, attorneys, accountants, real estate
appraisers, or other professional persons; real estate, insurance, credit service (other than loan) offices
and similar businesses supplying services instead of products when determined by the Planning
Commission upon application to it, to be consistent with the nature and condition of neighboring uses
and structures.
2. Buildings to be used exclusively to house the offices of civic, religious or charitable organizations, the
activities of which are conducted by mail, and which are not displaying or handling merchandise or
rendering service on the premises.
3. Schools and colleges not involving the use of mechanical equipment except such as is customarily
found in dwellings or professional offices provided that any such building shall be located not less
than thirty (30) feet from any other lot in any residential district.
4. The office of a resident physician, dentist, architect, engineer, attorney, or similar professional person
when located within his dwelling, provided that not more than one (I) person not a resident in said
dwelling is employed in such offices.
5. Hospitals, sanitariums, and convalescent or nursing homes.
6. Previously existing or established commercial uses not already converted to a residential use may be
authorized under Special Use Permit for the following [amended 12/99]:
ARTICLE XIII - B-4 GENERAL BUSINESS DISTRICTS
PREAMBLE
The B-4 General Business District is designed to provide for a wide variety of business activities including
automotive services and goods, and is generally incompatible with the uses in the B-1, B-2, and B-3 Business
Districts. Placement along presently developed major traffic arteries prevents the conflict of traffic and

pedestrian movement since the General Business District is characterized by a minimum of pedestrian flow.
The B-4 General Business Districts have been located in areas designated on the adopted Land Use Plan.
SECTION 1300: PRINCIPAL USES PERMITTED
In the B-4 General Business District, no building or land shall be used and no building shall be erected,
structurally altered, or occupied except for one (I) or more of the following specified uses, unless otherwise
providing in this Ordinance:
1. Veterinarian clinics, without outdoor kennels.
2. Bus passenger stations.
3. Stores selling second hand merchandise.
4. Funeral homes.
5. Automobile car wash, when completely enclosed in a building.
6. Auto service stations for the sale of gasoline, oil, and accessories ... ,
7. Self service laundry and dry cleaning establishments.
8. Amusement, entertainment, and recreational, including bowling alleys and skating rinks.
9. Storage of non-hazardous and non-toxic materials or goods provided such storage is within a building
or is enclosed as not to be visible to the public from any abutting residential district or public street.
10. Theaters, when completely enclosed.
11. Banks, with or without drive-in facilities.
12. Restaurants and cocktails lounges.
13. Motels and hotels.
14. Residential uses as pmi of a building in this business zone shall be allowed upon issuance of a
Certificate of Occupancy from the Department of Inspections, but provided that the minimum lot area
requirements of the RM-3 District are met.
15. Assembly of small parts provided that there shall be no machining, painting, cutting, grinding, or
welding of pmts.
16. Principal Use as permitted in B-2 Districts.
SECTION 1301: SPECIAL LAND USES PERMITTED
The following uses, and their accessory buildings and accessory uses, shall be permitted under the purview of
Section 2332 after review and approval of the use (and a site plan, if required) by the Planning Commission,
after Public Hearing, subject to the applicable conditions, and any other reasonable conditions imposed by the
Planning Commission. A site plan shall not be required when there is no change to buildings or existing
facilities.

1. What, if any, identifiable conditions related to the petition have changed which justify

Mayor Nielsen opened the meeting with a prayer after which members of the City

item. Vince Provanzano and Roger Morganstern from Consumers Energy were
present to answer any questions. Gregory Laws, 1231 Fifth Street, inquired as to how
the hiring would be handled, if they were going to hire from within or not.

SUMMARY OF REQUEST: To approve the sale of the vacant buildable lot (number
632) designated as map number 24-31-21-153-003 to Lighthouse Tabernacle Church.
The lot is approximately 66 feet x 132 feet and is located between Mary and Getty
Streets. The parcel is being offered to the church for $3,900. The subject lot will be
used to meet parking requirements as determined by the Planning Commission. The
sale is contingent upon the alley being vacated.
FINANCIAL IMPACT: The sale of this lot will allow the property to be placed back
on the City's tax rolls (but exempt from payment) thus relieving the City of continued
maintenance costs.
BUDGET ACTION REQUIRED: None
STAFF RECOMMENDATION: To approve the resolution and to authorize both the
Mayor and the Clerk to sign said resolution. The Planning Commission recommended
approval of this sale at their June 14 meeting.

SUMMARY OF REQUEST: To allow non-profit organizations to purchase two or more
non-buildable lots for the purpose of "creating" buildcble lots, in which to construct
single family homes. Sales would be allowed whether or not the non-profit
organization owned property adjacent to the subject parcel(s). These sales would
be reviewed by the LRC on a case by case basis before final approval by City
Commission.
FINANCIAL IMPACT: These types of sales will further the ability of staff to increase
the number of properties returning to the city's tax rolls thus relieving the City of
continued maintenance costs.

SUMMARY OF REQUEST: To approve the sale of four non-buildable lots designated
as map numbers 24-31-20-180-015; 016; 017; and 018, for the construction of two (2)
single family homes for $400 (four lots @ $100/each). Each of the proposed homes
will have 66 feet of frontage and will include the following amenities; brick; front
porches; shutters; and decorative windows. As the lots are adjacent, noticeable
differences in exterior design are a condition of sale. The sales of these lots are
contingent on approval of the Jackson Hill Neighborhood Association.
FINANCIAL IMPACT: Approval of the sale allows the property to be placed on the
City's tax rolls thus relieving the City of continued maintenance costs.

regarding the Amoco property.
Mayor Nielsen said that the lots on Yuba have been cut, but that it was very
uneven.
PUBLIC PARTICIPATION:
Helen Abbey, 760 Catherine inquired as to when the Lakeshore Trail will be
completed.
Gregory Laws, 1231 Fifth St. asked when 5th and 6th Streets will be repaved. The
City Manager replied.
Cheryl Ferris, 1721 Woodside Rd. asked why there is no camping out at Heritage
Landing. She was informed that Heritage Landing is County property.

Bob, attached is a request for Commission approval of the budgeted radio
replacements for 2000. Again I am requesting to purchase Motorola brand
equipment, and due to their sales territories only one dealer can bid. I have
cpmpared the prices to past purchases of this equipment and there is a small increase
i;in tlw portable units and a small decrease in the mobile units.
0~~land did not bid anything comparable, and the State Police have switched to
!tll\ligit;ilradios. Although other manufactures do build comparable radios, we made
i{.deoisiort to go with Motorola radio equipment in the past, and our goal is to
niidntainihe same model radio in the fleet so that we do not have any compatibility
prol:)Jerris with other existing equipment. There is also a safety concern with
errieigency situations, where having the same model in all cars will allow the officer
tprespond easier, do to familiarity with the radio.
The current units continue to give us excellent service life, do to their high
quality and reliability. It is my recommendation that we continue to use this model
to remain compatible with the rest of are units. Especially due to the fact that we
will have to upgrade to digital frequencies soon and these units will be compatible
with that technology when we are ready to switch.

RESOLUTION APPROVING REQUEST
FOR ESTABLISHMENT OF INDUSTRIAL DEVELOPMENT DISTRICT
CONSUMERS ENERGY
WHEREAS, pursuant to Act No. 198 of the Public Acts of 1974, as amended, the City
of Muskegon has the authority to establish an "Industrial Development District" within
the City of Muskegon; and
WHEREAS, Consumers Energy, 151 N. Causeway, Muskegon, Michigan, has
requested the City of Muskegon to establish an Industrial Development District on
property located at 151 N. Causeway, Muskegon, Muskegon hereinafter described;
and
WHEREAS, Consumers Energy will locate production facilities within the Industrial
Development District; and
WHEREAS, construction, acquisition, alterations, or installation of a proposed facility
has not commenced at the time of filing the request to establish this district; and
WHEREAS, written notice has been given by mail to all owners of real property located
within the proposed district, and to the public by newspaper advertisement in the
Muskegon Chronicle and public posting of the hearing on the establishment of the
proposed district; and
WHEREAS, a public hearing on the establishment of an Industrial Development District
was held on June 27, 2000, at the regular City Commission meeting at the Muskegon
City Hall at which time all of the owners of real property within the proposed district, all
residents and taxpayers of the City of Muskegon, and the affected taxing jurisdictions
were afforded an opportunity to be heard thereon.
NOW THEREFORE BE IT RESOLVED THAT, the Muskegon City Commission deems
it to be in the best interest of the City of Muskegon that the following described land
situated in the City of Muskegon, Muskegon County, and the State of Michigan, to wit:
Part of Sections 17 an d18, T10N, R16W, more particularly described as follows:
Beginning at the intersections of the boundary line of the City of Muskegon and the Westerly
line of the Pere Marquette Rail Road right-of-way; thence Northerly along said Rail Rod right-
of-way to the Southwesterly line of Trunk Line Highway US-31; thence Northwesterly along
said Trunk Line Highway to the Southeasterly boundary line of the City of North Muskegon;
thence Southwesterly along said boundary line to Muskegon Lake; thence Southerly along
said Lake to the center of the North Channel of the Muskegon River, said line also being the
North boundary line of the City of Muskegon; thence Easterly along said boundary line to the

CONSUMERS ENERGY
WHEREAS, pursuant to PA 198 of 1974 as amended, after duly noticed pubic hearing held on
June 27, 2000, this Commission by resolution established an Industrial Development
District #"2000-65a as requested by Consumers Energy, B.C. Cobb Plant, 151 North
Causeway, Muskegon, Michigan, 49445; and
WHEREAS, Consumers Energy has filed an application for the issuance of an Industrial Facilities Tax
Exemption Certificate with respect to a new machinery and equipment to be installed within the
Industrial Development District# 2000-65a · and
WHEREAS, before acting on said application the Muskegon City Commission held a public hearing on

WHEREAS, installation of machinery and equipment had not begun earlier than six (6) months before
June 2, 2000, the date of the acceptance of the application for the issuance of an Industrial
Facilities Tax Exemption Certificate; and
WHEREAS, installation of machinery and equipment is calculated to and will have the reasonable
likelihood to retain, create, or prevent the loss of employment in Muskegon, Michigan; and
WHEREAS, the aggregate SEV of real property exempt from ad valorem taxes within the City of
Muskegon, will not exceed 5% of an amount equal to the sum of the SEV of the unit, plus the
SEV of personal and real property thus exempted.
NOW, THEREFORE, BE IT RESOLVED by the Muskegon City Commission of the City of
Muskegon, Michigan that:
1) The Muskegon City Commission finds and determines that the Certificate considered
together with the aggregate amount of certificates previously granted and currently in force
under Act No. 198 of the Public Act of 1974 as amended and Act No. 255 of the Public Acts
of 1978 as amended shall not have the effect of substantially impeding the operation of the
City of Muskegon or impairing the financial soundness of a taxing unit which levies ad
valorem property taxes in the City of Muskegon.
2) The application of Consumers Energy, for the issuance of an Industrial Facilities Tax
Exemption Certificate with respect to installation of new machinery and equipment on the
following described parcel of real property situated within the City of Muskegon Industrial
Development District# 2000-65a to wit:
Part of Sections 17 an d18, T1 ON, R16W, more- particularly described as follows: Beginning
at the intersections of the boundary line of the City of Muskegon and the Westerly line of the
Pere Marquette Rail Road right-of-way; thence Northerly along said Rail Rod right-of-way to
the Southwesterly line ofTrunk Line Highway US-31; thence Northwesterly along said Trunk
Line Highway to the Southeasterly boundary line of the City of North Muskegon; thence
Southwesterly along said boundary line to Muskegon Lake; thence Southerly along said
Lake to the center of the North Channel of the Muskegon River, said line also being the

generators at the B.C. Cobb plant. The proposed "repowering" includes the installation of new
equipment to burn natural gas instead of coal to generate electricity. The subject generators

To approve the sale of the vacant buildable lot (number 632) designated as
map number 24-31-21-153-003 to Lighthouse Tabernacle Church. The lot is
approximately 66 feet X 132 feet and is located between Mary and Getty
Streets. The parcel is being offered to the church for $3,900. The subject lot
will be used to meet parking requirements as determined by the Planning
Commission. The sale is contingent upon the alley (see map) being vacated.

Dollars ($200) as a dowu payment; therefore, the sum of Seven Thousand Three Hundred Dollars
($7,300), the balance of said purchase price, shall be payable, in cash, to Seller at closing.
3. Taxes and Assessments. All taxes and assessments which are due and payable at the time
of closing shall be paid by Seller prior to or at closing. All taxes and special assessments which become
due and payable after closing shall be the responsibility of Buyer.
4. Title Insurance. Seller agrees to deliver to Buyer's attorney, ten (10) days prior to closing,
a commitment for title insurance, issued by Transnation Title Insurance Company, for an amount not less
than the purchase price stated in this Purchase Agreement, guaranteeing title on the conditions required
herein. In the event the reservations, restrictions or easements of record disclosed by said title
commitment are, in the sole discretion of Buyer, deemed unreasonable, Seller shall have forty-five (45)
days from the date Seller is notified, in writing, of such unreasonableness of restriction and such
unmarketability of title, to remedy such objections. If Seller resolves such restrictions and remedies to the
title (by obtaining satisfactory title insurance or otherwise) within the time specified, Buyer agrees to
complete this sale as herein provided within ten (I 0) days of written notification thereof. If Seller fails to
resolve such restrictions or to remedy the title within the time above specified, or fails to obtain
satisfactory title insurance, this Purchase Agreement will be terminated at Buyer's option. The premium
for the owners title policy shall be paid by Seller.
5. Survey, Buyer, at its own expense, may obtain a survey of the Premises, and Buyer, or its
surveyor or other agents, may enter the Premises for that purpose prior to closing. If no survey is
obtained, Buyer agrees that Buyer is relying solely upon Buyer's own judgment as to the location,
boundaries and area of the Premises and improvements thereon without regard to any representations that

without any compensation or credit to the Buyer. The provisions in this paragraph shall survive the
closing and run with the land.
I 0. Closing. The closing date of this sale shall be on or before February 2 2 , 2 0 0 0
("closing"). The closing shall be conducted at Transnation Title Insurance Company, 570 Seminole Road,
Ste. 102, Muskegon, MI 49444. If necessary, the parties shall execute an IRS closing report at closing.
11. Delivery of Deed. Seller shall execute and deliver a quit claim deed to Buyer at closing
for the Premises.
12. Affidavit of Title. At closing, Seller shall deliver to Buyer an executed Affidavit of Title.
13. Date of Possession. Possession of the Premises is to be delivered to Buyer by Seller on the
date of closing.
14. Costs. Seller shall be responsible to pay the Michigan transfer tax in the amount required
by law. Seller shall be responsible to pay for the recording of any instrument which must be recorded to
clear title to the extent required by this Purchase Agreement. Buyer shall pay for the cost of recording the
warranty deed to be delivered at closing.
15.. General Provisions.
a. Paragraph Headings. The paragraph headings are inserted in this Purchase
Agreement only for convenience.
b. Pronouns. When applicable, pronouns and relative words shall be read as plural,
feminine or neuter.
c. Merger. It is understood and agreed that all understandings and agreements
previously made between the Buyer and Seller are merged into this agreement, which alone fully
and completely expresses the agreement of the parties.
d. Governing Law. This Purchase Agreement shall be interpreted and enforced
pursuant to the laws of the State of Michigan.
e. Successors. All terms and conditions of this Purchase Agreement shall be binding
upon the parties, their successors and assigns.
f. Severability. In case any one or more of the provisions contained in this Purchase
Agreement shall for any reason be held to be invalid, illegal, or unenforceable in any respect, such
invalidity, illegality, or unenforceability shall not affect any other provision of this agreement, and
this agreement shall be construed as if such invalid, illegal, or unenforceable provision( s) had
never been contained herein.
g. Survival of Representations and Warranties. The representations, warranties,
covenants and agreements contained in this Purchase Agreement and in any instrument provided

for herein shall survive the closing and continue in full force and effect after the consummation of
this purchase and sale and continue until all liabilities of Buyer have been fully satisfied.
h. Modification of the Agreement. This Purchase Agreement shall not be amended
except by a writing signed by Seller and Buyer.
