Western Ave. Suite 202, Muskegon, MI or at the call of the chair. 8) Adjournment To: Muskegon Business Improvement District Board Ww From: Dave Alexander, DMN executive director Re: Comments/background on Jan. 24 agenda items Date: Jan. 20, 2017 Election of officers: At our Nov. 22 meeting, the board informally agreed to continue with its current leadership of Doug Pollock as chairman and Justin Clark as vice chairman. On Tuesday, | will start the meeting, call for nominations and conduct the vote. The elected chairman will run the remainder of the meeting. Financial report: The BID financial report as of Jan. 20 shows that we have $41,304 in our account, an amount yet to show the $20,407 in assessment revenues for 2016 not yet received but also not reflecting a total of $16,000 in sidewalk snow removal services not paid the city for December and January. As of the time that the unpaid assessments were put on the 2017 winter tax bills, $20,407 was owed by 28 property owners in the BID. That is 17.7 percent of the $115,223 generated by the BID in 2016 and 21.3 percent of the 131 total property payers. The BID will receive the $20,407 in assessments paid by Feb. 14 and the $115,223 in 2017 assessments paid in the winter tax bills as of Feb. 14 sometime in late February or early March. The unpaid assessments as of Feb. 14 will become delinquent and subject to a Muskegon County delinquent property tax bond. The BID’s share of those bond revenues will be distributed to us sometime in June. Sidewalk snow removal update: We have been blessed as a BID with moderate snow early in the winter and a very warm January. | have in your packet the signed letter of understanding on sidewalk snow removal between the BID and the city DPW. Also, Mohammed Al-Shatel has provided us a financial summary of city costs through Jan. 13. First, | want to recognize what | have found as the fine service of city staff. Especially responsive has been DPW’s Kevin Santos who | work with on downtown issues. The city staff has been responsive and customer service oriented. A case in point, is the request ofJerviss-Fethke Insurance and Burger King for service on the east end of the BID. Two streets were added by Frank and DPW at no cost to address those two business’ concerns. Besides those two businesses, | have not received one phone call or email on sidewalk issues, Every morning when the 2-inch trigger has been reached, the sidewalks are cleared and salted if conditions warrant. As for our financial standing, we are paying $8,000 a month for Monday-Saturday service and time and materials for Sunday. Mo has provide us an accounting showing a city expenditure of $9,227 through Jan. 13 with $1,804 coming in additional costs. Mo as waived the additional $1,804, accepting as full payment the $16,000 for December and January. That leaves us with approximately $4,400 unspent from the budget for the first two months of the year for potential additional charges for time and materials not covered in the monthly payment the rest of the year. | will also raise with Frank Peterson at our Tuesday meeting the potential of moving some of our budget snow removal over to landscaping if such a mild winter continues. | would point out the transparency of it all, these are internal financial statements no private contractor would ever be willing to divulge. 2017 DMN-BID letter of understanding: The two organizations signed a letter in 2016. With the extension of the BID, the letter needs updating for 2017. A proposed update is included in the packet showing the changes in bold, mainly acknowledging the $25,000 administration fee the BID is paying DMN for its services. The DMN board already as unanimously approved the 2017 letter. 2017 Landscaping: | have added to your packed the 2016 landscaping RFP, H&H landscaping contract and the O’le Henry planter contract (services delivered separately without a RFP). | need direction for 2017. As has been the case with sidewalk snow removal, | want to explore city providing landscape services for 2017. The end of 2016 showed what the city is capable of if it is willing to continue such attention on downtown. The problem with the city and H&H last year was overlapping efforts that were not really coordinated. Another letter of understanding between the BID and the city DPW might provide the best use of the $16,000 budgeted for landscaping. That budget includes the 27 planters. If the city is not interested in the planters portion of the downtown landscaping, | would like to bid that work out separately. We spent $1,900 for the materials and initial planting and $4,200 for weekly watering and maintenance. | think O’le Henry did a fine job as many expressed pleasure with the planters in 2016. However, | want to make sure we get the best bang for our buck with a new RFPif the city does not provide that service. Likewise, | would want to do another RFP for the overall landscaping if we do not go with the city. First Friday contribution: BID is being asked to financially support the initial three First Fridays in 2017. Please see the poster that | have included in the packet. BID gave $2,500 in 2016. Similarly, this $2,500 request would come from the 2017 events and marketing account of the BID, which has been budgeted at $24,000. Helping out First Fridays now will assist us in our transition with Ellen Berends leaving. Downtown message signs: | sent you an email concerning the $3,000 in foundation grants DMN received. | want to spend those on downtown message sign boards through the BID and its streetscape fund. | need to know how you want me to proceed. Pop-up Shops: Cindy Larsen and Frank will make a pitch for BID participation. If comfortable with the expenditure, | would suggest the funds — $5,000 request — come out of the $13,000 BID streetscape account. Western Avenue condo association: Gary Post will make a formal request for the BID to help with the public space expenses along Third Street. The condo groups is meeting in the near future and Gary would like to report the BID’s response back to them. | think the request is legitimate but the BID could only commit to helping out one year at this point. The board chose to leave the floor open for the whole meeting allowing attendees to participate as they like. 5) Unfinished Business a) The BID board had before it the final approval of a Letter of Understanding between the BID and the city Department of Public Works for downtown sidewalk snow removal for 2016-17. H&H continues to provide parking lot and alley snow removal per the BID request for proposals. The topic generated many questions, comments and debate. Doug Pollock wanted the letter to reflect the BID not paying for the entire month of November since no snow removal services were needed. Bob Tarrant agreed. John Riegler said that the beginning of the season has backed the BID board into a corner on this issue. The proposed agreement results in a lot less service and a lot more cost than last winter with a private contractor, Doug Pollock said. He wants to bid out the service next year to determine what the best competitive cost is. Gary Post pointed out the compromise of a 1.5 inch trigger to a 2 inch trigger for all days of the week and weekends. Mohammed Al-Shatel said that the city and the downtown BID property owners are all in this together. He suggested a $7,500 a month December through March for downtown sidewalk snow removal as proposed. 1 Gary Post said that is an arbitrary number because no really knows the exact costs of sidewalk snow removal. Mohammed Al-Shatel said he'd like to try it the next four months. Doug Pollock said he is suspicious with government having a “pot of money” and that the BID should be stingy with its resources. Mohammed Al-Shatel said this is “not a money-making” proposition for the city. DPW wants to do the best job possible. BID was sold on sidewalk clearing, Mike Hennessy said. Mohammed A\l-Shatel said that weekend coverage should be on the major downtown arteries of Clay, Western, Morris and Third. He said DPW would handle Monday through Saturday for a flat fee of $8,000 a month with Sunday be additional on a time and materials basis. The weekend service would be Western from Terrace to Seventh, Clay from Terrace to Third, Morris from Terrace to Third and Third from Morris to Merrill. Such a compromise with $8,000 a month flat fee for December through March for Monday to Saturday service and Sundays on an as-needed basis for the cost of time and materials. The weekday service map would be as proposed and the weekend service map as outlined above by Mohammed Al-Shatel. This will be put into a letter of understanding written by Dave Alexander and signed by the BID board and the city. Motion: Mike Hennessy Support: Frank Peterson Vote: All voted in favor 6) New Business a) Dave Alexander presented a 2017 BID budget and work plan that was from the originals approved in the BID by the city commission. However, the $150,000 expenditure budget -- with revenues including fund balance from 2016 -- for city accounting purposes was divided into two halves Jan. 1-June 30 and July 1-Dec. 31. The budget was divided and the Jan. 1-June 30 was before the BID board for approval. Motion: Bruce Lindstrom Support: Bob Tarrant Vote: All voted in favor b) The BID board discussed the assessment district going forward beyond 2017, which already has been approved by the Muskegon City Commission. Chairman Doug Pollock appointed himself, Bob Tarrant and Mike Hennessy to work with Dave Alexander to arrive with a recommendation for the BID board for its March 28 meeting. Subsequently, the BID board will need to make a recommendation to the Muskegon City Commission. 7) Other Business a) Ellen Berends updated the BID board on events and decorations for the end of 2016. DMN partnered with the city for a highly successful Halloween event Saturday Oct. 29. The final First Friday event was Nov. 4 at the Lakeshore Museum of Art. First Fridays will pick back up in February 2017 with the downtown Snowfest celebration of the Muskegon Greater Jaycees. Plans are set for Holidays in the City and the Community Christmas Tree Lighting Nov. 26. Christmas decorations this year are being provided to the BID and the city for downtown by the Bailey Family company on a seasonal rental arrangement. The BID will contribute its $2,500 budgeted for Christmas decorations with the remainder paid for by the city of Muskegon. b) The board discussed its chairmanship. The consensus was to remain with current board leadership in 2017. A formal vote will be the first meeting in 2017. c) The next meeting is Tuesday Jan. 24, 2016 4 p.m. in the chamber training room, 380 W. Western. H&H Landscaping and Snowplowing Services of North Muskegon will continue providing parking lot and alleyway snow removal this coming season as they have in previous winters. For December 2016 through March 2017, the BID will pay the city a total of $32,000 as a retainer to provide the outlined services below for Monday through Saturday. Sunday sidewalk services from December 2016 through March 2017 will be requested on an “as needed” basis and billed by the city for time and materials. Monthly costs and invoices will be sent to Downtown Muskegon Now as managers of the BID and paid by the city Finance Department with BID funds to the DPW. Muskegon DPW will provide DMN a monthly accounting of the downtown sidewalk activity and expenses, reports that will be shared with BID board members. Sidewalk snowplowing, salting (as needed) and snow pile removal (as needed) will be provided by the city when fresh snow accumulations are 2 inches or greater measured at Third Street and West Western Avenue each morning. The goal with overnight snowfalls is to clear the sidewalks by 10 a.m. the next morning starting along Western Avenue, if possible. Sidewalk snowplowing services provided by the city on Sundays and holidays will result in higher charges due to overtime and will be triggered by downtown needs. Sidewalk snow clearing is more limited on Saturdays as outlined below. The goal on Saturdays is to have the sidewalks on the main streets of Western, Clay, Morris and Third cleared by noon or as needed. The area of sidewalk snow removal services is shown on the attached maps. Wester Traffic Circle - The cross walks in the traffic circle at 3 and Western should also be cleared Salting and snow pile removals - Salting of sidewalks and crosswalk entrances will be done when they are treacherous and weather conditions for salting are favorable. - Snow pile removal will be done when needed in coordination with piles from street plowing. Issues concerning the daily sidewalk snow plowing services will be handled jointly by Dave Alexander, executive director of Downtown Muskegon Now on behalf of the BID or BID board members residing downtown on weekends and holidays and city Public Works Director Mohammed Al-Shatel or his designee. On Jan. 12, 2016, the Muskegon City Commission unanimously approved the final district property assessments to launch the BID. The BID was renewed for 2017 by the commission On Oct. 25, 2016. © Atits Jan. 19, 2016 meeting, the BID Board of Directors selected DMN to provide staff services to the district. DMN will administer the operations of the BID and be the liaison to the city of Muskegon and its staff. DMN will received $25,000 in 2017 from the BID for administrative services. © The BID Board with the help of DMN staff established the 2017 budget at its Nov. 22, 2016 meeting, which DMN will carry out on behalf of the BID Board. The BID board can establish specific expenditures of BID funds through the budget process. e DMN staff will expend the funds and report at least quarterly to the BID board on the work completed. DMN will provide an annual report to the BID each January. e The BID Board in the first half of 2017 will work on recommendation for a multi-year extension of the BID and a review of the district and its assessments. Date: January 10, 2017 AMERICAN DISABILITY ACT POLICY FOR ACCESS TO OPEN MEETINGS OF THE CITY OF MUSKEGON AND ANY OF ITS COMMITTEES OR SUBCOMMITTEES The City of Muskegon will provide necessary reasonable auxiliary aids and services, such as signers for the hearing impaired and audio tapes of printed materials being considered at the meeting, to individuals with disabilities who want to attend the meeting with twenty-four (24) hours notice to the City of Muskegon.
